WHEREAS, also in connection with the same state highway project, Grantor acquired the <br />following parcels of real property as excess land or uneconomic remnants: <br />Parcel 122EL Calvin F. Southern and Vol. 12974, Page 323 <br />Bertha C. Southern <br />Parcel 123EL John F. Bode Vol. 12960, Page 321 <br />Parcel 124EL Ronald A. Foor and Vol. 12996, Page 321 <br />Patricia M. Wolfe <br />;and <br />WHEREAS, also in connection with the same state highway project, Grantor acquired the <br />following parcel of real property as a portion of right of way of Butternut Ridge Road and <br />developed and constructed a pedestrian/bike path on it: <br />Parcel 166WD Theodore J. DeWerth and Volume 14214, Page 83 <br />Jane E. DeWerth <br />and <br />WHEREAS, the above-mentioned properties were acquired using funding from the Federal <br />Highway Administration for an interstate highway project and are subject to 23 CFR 710.409 <br />for disposal; and <br />WHEREAS ,the above captioned highway project and multi -use path were constructed and <br />opened to traffic, and: <br />WHEREAS, the Director of Transportation, under authority of Section 5501.34 and 5501.45 <br />of the Ohio Revised Code and 23 C.F.R. 710.105 (b), after consulting with the Director of the Ohio <br />Department of Natural Resources, has determined that certain portions of the above -referenced <br />properties more fully depicted on and/or described in Exhibit A ["the Subject Properties"] are no <br />longer needed for highway or recreation purposes and can be disposed of without affecting the integrity <br />of state highway system; and <br />WHEREAS, the City of North Olmsted, Ohio, the Grantee, is a political subdivision of the <br />State of Ohio and therefore eligible under Section 5501.45 of the Ohio Revised Code to have the <br />Properties conveyed to it upon such consideration as may be determined by the Director of <br />Transportation to be fair and reasonable without competitive bidding for continued public use <br />consistent with 23 C.F.R. 710.409; and <br />WHEREAS, Grantee intends to undertake and/or continue public uses of certain portions <br />of the Subject Properties by developing and constructing underground sanitary sewer storage <br />facilities and/or storm sewer retention facilities to manage storm water drainage on certain <br />Page 2 of 9 <br />
