MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />NOVEMBER 16, 2021 <br />Present: Council President Jones, Council Members Brossard, Glassbum, Hemann, <br />Kelly, Limpert, Schumann & Williamson <br />Also Present: Director of Finance Copfer, Director of Law Gareau, Director of Planning <br />& Community Development Lieber and Clerk of Council Massarolo <br />Absent: Councilmembers Brossard and Schumann; Mayor Kennedy <br />Council President Jones called the meeting to order at 8:00 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in the recitation of the Pledge of <br />Allegiance. <br />The Council Meeting Minutes of November 3, 2021 were approved as written. <br />The following legislation will be considered for passage under suspension of the rules <br />this evening: Second Reading: Resolution 2021-64; First Reading: Ordinance 2021-70. <br />REPORTS <br />Director of Law Gareau: <br />• The matter regarding the dog bite case that is in Rocky River Municipal Court, it <br />is set for a final pretrial hearing on December 16 at 8:15 a.m. It is anticipated the <br />matter will be set for trial. Also related, on November 18 there is a preliminary <br />injunction hearing set in the Cuyahoga County Court of Common Pleas to enforce <br />the order issued through the administrative process. <br />• Notice was received yesterday about a second settlement the City would be <br />eligible to receive funds from in the opioid litigation. More information will be <br />given once it is received, but it is the Johnson & Johnson litigation. <br />Councilwoman Hemann asked if the Department of Law had been tracking what she had <br />read about Johnson & Johnson being interested in a bankruptcy filing to avoid these <br />judgements. Director Gareau responded he had not, he just got this notice yesterday and it <br />might be through negotiations in lieu of bankruptcy. He said there are a number of cases <br />out there, some split off from the class to settle. Councilwoman Hemann asked the <br />Director to check it on PACER. <br />Councilman Glassburn asked the Director of Law if there is an update regarding the <br />Westbury apartments. Director Gareau said the plea is set in Rocky River for December <br />6. The owners are required to present to the City a professional schedule for repairs. <br />Instead, they are using a very basic form, which the City has not accepted. The City <br />continues to work with the Westbury and the lender and it is a slow grind. There is a case <br />in Common Pleas Court and in Rocky River. Director Gareau said he will share an update <br />
