Council Minutes of 11-01-2022 The Intra -Governmental Relations Committee met to consider Mayor Jones' recommendations for Appointment to the Building and Zoning Board of Appeals and the Arts Commission. Discussed the appointment of Mr. Mike Kovach to the Building and Zoning Board of Appeals to fill a vacant position for the term of January 1, 2019 to December 31, 2023, as well as the appointment of Mr. Shaun McGrath to the Arts Commission for the term of January 1, 2022 to December 31, 2025. At the conclusion of the discussion, Ms. Gilchrist made a motion to approve the appointments as read, seconded by Councilwoman Hemann and the Committee vote was unanimous to recommend the appointments of Mr. Kovach and Mr. McGrath and the Committee Meeting concluded at 745 p.m. Councilwoman Gilchrist moved to approve the appointment of Mr. Mike Kovach to the Building and Zoning Board of Appeals to fill a vacant position for the term of January 1. 2019 to December 31, 2023. The motion was seconded by Councilwoman Hemann by a vote of 7-0. Roll Call. Yes: Gilchrist, Hemann.. Glassburn, Kelly, Limpert, Scarl, Williamson No. None Motion carried. Mr. Shaun McGrath is appointed to the Arts Commission for the term of January 1, 2022 to December 31, 2025 by a vote of 7-0. None Mr. Malek Khawam Attorney for David Kovatch. Best D"n Tacos/Sacred Waters Appearing today to address Resolution 2022-100. Wanted to highlight what he feels are issues with the legislation. Mr. Khawam stated that temporary moratoriums are appropriate in certain circumstances but feels when a Moratorium is issued without consideration of businesses it implicates due process concerns as well as government taking. He feels based on the Resolution that there is not a reasonable plan to resolve Council's concerns as it relates to the substances listed in the moratorium. Businesses that are currently operating and serve the particular substances listed in the moratorium, are legally not affected by the moratorium as it cannot apply retroactively, therefore Kava/Sacred Waters West will be able to operate.
