Council Minutes of 11-01-2022 <br />The Intra -Governmental Relations Committee met to consider Mayor Jones' <br />recommendations for Appointment to the Building and Zoning Board of Appeals and the <br />Arts Commission. <br />Discussed the appointment of Mr. Mike Kovach to the Building and Zoning Board of <br />Appeals to fill a vacant position for the term of January 1, 2019 to December 31, 2023, <br />as well as the appointment of Mr. Shaun McGrath to the Arts Commission for the term of <br />January 1, 2022 to December 31, 2025. At the conclusion of the discussion, Ms. <br />Gilchrist made a motion to approve the appointments as read, seconded by <br />Councilwoman Hemann and the Committee vote was unanimous to recommend the <br />appointments of Mr. Kovach and Mr. McGrath and the Committee Meeting concluded at <br />745 p.m. Councilwoman Gilchrist moved to approve the appointment of Mr. Mike <br />Kovach to the Building and Zoning Board of Appeals to fill a vacant position for the term <br />of January 1. 2019 to December 31, 2023. The motion was seconded by Councilwoman <br />Hemann by a vote of 7-0. <br />Roll Call. <br />Yes: Gilchrist, Hemann.. Glassburn, Kelly, Limpert, Scarl, Williamson <br />No. None <br />Motion carried. Best D"n Tacos/Sacred Waters <br />Appearing today to address Resolution 2022-100. Wanted to highlight what he feels are issues <br />with the legislation. Mr. Khawam stated that temporary moratoriums are appropriate in certain <br />circumstances but feels when a Moratorium is issued without consideration of businesses it <br />implicates due process concerns as well as government taking. He feels based on the <br />Resolution that there is not a reasonable plan to resolve Council's concerns as it relates to the <br />substances listed in the moratorium. Businesses that are currently operating and serve the <br />particular substances listed in the moratorium, are legally not affected by the moratorium as it <br />cannot apply retroactively, therefore Kava/Sacred Waters West will be able to operate. <br />
