from $2,500.00 to .$37,283.00, in order to take advantage of the opportunity to identif7 <br />additional energy conservation measures related to the city infrastructure. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYA HOCA, AND STATE OF OHIO: <br />SECTION 1: that Section 2 of Ord. 2022-38. which reads in its entirety as <br />follows be amended and, as amended. shall read in its entirety as follows with such <br />amendments noted by bold text and strike through of language: <br />SECTION 2: That the !Mayor be and she is hereby authorized, upon approval of the Board <br />of Control, to enter into an agreement with the fin selected in the RFP process. Said <br />Agreement shall not authorize expenditure of funds, except as otherwise appropriated <br />therefore. and shall provide the Energy Services Performance Consultant be compensated <br />in connection with utility cost savings actually realized upon implementation of energy <br />conservation measures or reduced energy, consumption. In the event that no energy <br />conservation measures are implemented. nor costs or consumption otherwise reduced, the <br />Agreement may provide for payment not in excess o within a range of $2,500 to <br />$37,283.00 to conduct an energy performance audit Said agreement shall be presented to <br />the Director of Law in form or in substance that are not substantially adverse to the Cite <br />and which are approved by the Director of Law. The character of any such changes as not <br />being substantially adverse to the City shall be evidenced conclusively by the execution <br />of the agreement by the Mayor and the approval of the agreement by the Director of Law. <br />SECTION 2: That any provision of Ord. 2022-38 not expressly modified herein <br />shall remain in full force and effect. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the public health, safety and welfare and for the further reason <br />that the energy efficiency RFP authorized by Ord. No 2022-38 has produced a tentative <br />agreement which remains subject to the financial limitation thereby imposed unless <br />immediately amended herein; and further provided it receives the alfirmalivc vole of two <br />thirds of the members of Council. it shall take effect and be in force immediately upon its <br />passage and approval by the Mayor. <br />PASSED, irst Reading: . <br />,Second Reading. <br />7hird Reading: -t . <br />Comminee: <br />TTTEW <br />v.� 7--�---E <br />BEATRICETAYLOR LOUPSJ.
