Jurisdiction and Cause of .Action <br />4. The City is authorized by Revised Code Sections 715,26 and 3767 41(B)(1) to bring an action <br />to abate a public nuisance relating to any property, building or structure within the City; farther <br />authorized to bring or action to enforce to enforce property maintenance and/or prohibit unsafe <br />structures, to wit, North Olmsted Codified Ordinances Chapters 1363 and 1164. <br />Facts <br />_. On March 24 and Apr:] 30, 2021, Property Maintenance James McGaughey (`Inspector") <br />observed and issue Notice of Code Violations at the Property and collected photographs dated <br />3/24/21 and 5/1.3/21. <br />6. Inspector observed that tree damage has compromised the integrity of the roof, caused the <br />sumoom ceiling to cnitapse, and photographed the nuisance conditions- Specifically, the glass <br />ceiling of the sun room has collapsed- <br />7_ The Property is and remains vacant, abandoned, blighted and a public nuisance by virtue of <br />the numerous unabated property maintenance, health and safety violations. The Property is <br />not habitable due to unsafe conditions <br />LegalCauses of Action <br />S. The Property is in asingle family residential zoning district in the City of North Olmsted and <br />had previously been occupied as a single family- residential structure, but has reportedly been <br />vacant or unoccupied and abandoned. <br />9. The Property is a public nuisance, in vmlarion of R 3767.41, as defined by subsection (A) <br />(2) la) as folio, ss <br />:A. building that is a menace to the public health. welfare or safety, that is strucmralhy <br />unsafe, unsanitary not provided with adequate safe egress; that constitutes a Ere hazard, is <br />otherwise dangerous !o human life or is otherwise no longer fit and habitable, or that, in <br />2 <br />
