19_ The City alleges upon information and belief, based on its prior demands to obtain comp':iance <br />with the law, that neither Defendants or other third panics is willing to abate the nuisance and <br />bring said premises into compliance with applicable law. <br />20. fhatthe Court invite lienholders to abate the public nuisance and/or authorize the appointment <br />of a receiver, to be funder authorized by Order of this Court to abate said public nuisance_ <br />21. Pursuant to R - § 3767-08, Defendants are subject to a County tax for maintaining the above- <br />described nuisance. <br />Praver <br />WHEREFORE, Plaintiff prays for the following relief Eom this Court: <br />1. Declare that the subject property, located at 28T7 Onng Road, coral Olmsted, OH 44070. <br />also known as Parcel No. 232-02-037, is a public nuisance and Order that it must be abated_ <br />2_ Issue an injunctive Order, pursuant to R s 3767 41, to preliminarily and permanently <br />enjoining Defendants from perpetuating and failing to abate said public nuisance, and <br />specifically requiring Defendant, no immediately commence the rehabilitation work, by <br />and through licensed contractors, subject to permit requirements o: the City, in abate the <br />public nuisance and restore the premises to habitable conditions within thirty (30) days. <br />3- A finding that the tide Owner has failed, notwithstanding reasoaable opportunity, to abate <br />the public nuisance and therefore an Order granting Defendant Northern Trust Company, <br />as henholder_ an opportunity to perform the work required by the Notice. <br />4. In the alternative, in the event that Defendants Cart to timely abate, isisc an Order <br />authorizing either the City or'a Colin appointed receiver, to undertake abatement actions. <br />at Defendants cosi., and/or as lien pursuant to R.C. 715.261 and 376741. <br />4 <br />
