The LPA agrees to participate in the cost of the Project for the 100°G) Local items such as, <br />but not limited to, decorative fence and attached lettering on fence with the City Name, <br />etc. <br />SECTION 4: Authority to Sign <br />the ITA herchp authorizes the Mayor of said City of North Olmsted to enter into and <br />execute contracts with the Director of I ansportation which are necessary to develop <br />plans for and to complete the above-described project: and to execute contracts with <br />ODO'Ipre-qualified consultants for the preliminary engineering phase of the Project. <br />Upon request of ODOT, the Ma}or is also empowered to execute any appropriate <br />documents to affect the assignment of all rights. tide, and interests of the City of North <br />Olmsted to ODOT arising from arc agreement with its consultant in order to allow <br />ODOT to direct additional or corrective work, recover damages due to errors or <br />omissions. and to exercise all other contractual rights and remedies afforded by law or <br />equity. <br />SECTION 5: Utilities and Hight of Way Statement <br />The LPA agrees that all right-of=wa} required for the described project will be acquired <br />and/or made availahle in accordance with current state and Federal regulations. the <br />LPA also understands that right-of-way costs include eligible utililN' costs. The LPA <br />ugrecs that all utility accommodation. relocation and reimbursement will cotnply with the <br />current provisions of -'3 CPN 645 and the ODO I Utilities Manual. <br />SECTION h: Maintenance <br />Upon completion of the Project. and unless otherwise agreed, the I.PA shall: ( I ) provide <br />adequate maintenance Ibr the Project in accordance with all applicable State and Federal <br />law, including, but not limited to, Title 23. U.S.C., Section 116: (2) provide ample <br />financial provisions, as necessary. lir the maintenance of the Project: (3) maintain the <br />right-of-way. keeping it free of obstructions: and (4) hold said right-of-way inviolate for <br />public highNeay purposes. <br />SECTION 7: Emergency Measure <br />that this Ordinance is hereby declared to he an emergency measure immediate]) <br />necessary for the preservation of the public health. safety and welfare and for the further <br />reason that the Project is on file with ODOT and immediate legislation is needed to <br />effectuate the award: and further provided that it receives the affirmative vote of two- <br />thirds of all members of Council, it shall take effect and be in force immediately upon its <br />passage and approval by the Mayor. <br />SECTION R: Certificate of Copy to State of Ohio <br />That the Clerk of Council shall and she is hereby directed. on the behalf of the City of <br />North Olmsted, as LPA, to certify a true and correct copy of this Ordinance and to deliver <br />sane, by both certified and ordinary mail. to the Director of the Ohio Department of <br />Transportation and to complete ODOT prescribed certification forms to document same. <br />
