MINUTES OF THE PUBLIC HEARING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />APRIL 4, 2023 <br />Present: Council President Brossard, Council Members Gilchrist, Glassburn, <br />Hemann, Limpert, Madden, Scarl and Williamson <br />Also Present: Mayor Jones, Director of Finance Copfer, Director of Law Gareau, <br />Director of Economic and Community Development Upton, Director of <br />Safety Scofield, Director of Human Resources Kidd, Special Assistant to <br />the Mayor. <br />President Brossard called the meeting to order at 7:43 p.m. <br />ISSUE: Ordinance 2023-18. An Ordinance Amending Section 1118.13 of the Planning <br />and Zoning Code of the Codified Ordinances of the City of North Olmsted entitled, <br />"Offices and Services", in order to limit the location of specified uses. <br />President Brossard reminded Council that during a Public Hearing the goal is to hear <br />concerns and issues from the audience. <br />The Economic and Community Development Director was asked to provide a brief <br />summary. <br />Director Upton stated the Ordinance places an additional requirement on the <br />conditional use for smoke shops, hookah, body branding, drug Paraphernalia and e - <br />cigarette shops. Chapter 1118.13 imposes two existing conditions by which one must <br />meet in order to secure a conditional use permit under the code. One is a limit of 3,000 <br />feet, measured lot line to lot line from any like use, the second of which indicates that <br />one must be in a shopping center that is at least 30,000 sq. feet, in the aggregate or <br />larger. The legislation places an additional condition of 2,500 feet from the nearest <br />school, playground, daycare facility, religious institution or public park. The <br />Administration feels these uses are incompatible, wherein it is not acceptable for <br />individuals to buy synthetic marijuana products and/or use them near playgrounds, <br />schools, daycare facilities or religious institutions. <br />AUDIENCE PARTICIPATION <br />Jim Burns <br />North Olmsted Chamber of Commerce <br />Mr. Burns stated the North Olmsted Chamber of Commerce does not disagree with the <br />types of restrictions, but rather the restrictions themselves. He stated that they do not <br />believe there is anywhere in the City wherein a business such as these can operate. He <br />disagreed with the lot line to lot line measurement statement, noting it should be door <br />to door. They would like to see the distances lessened. <br />
