Responsibilities of Concessionaire shall include, but are not limited to: <br />1. <br />Operate Concessions when the Recreation Complex is open and during such <br />hours or events as agreed in contract proposal. <br />2. <br />Provide food services as outlined by and at prices established by said contract <br />proposal. <br />3. <br />Hire, fire, pay, supervise, and schedule all food service employees, if at all, who <br />shall be employees of Concessionaire and shall not be employees of the City. <br />Supervision and control of such employees, if any, shall be the exclusive <br />responsibility of said Concessionaire. <br />4. <br />Solicit, supervise, and schedule all food service volunteers, who shall be <br />volunteers of Concessionaire and shall not be deemed employees of the City. <br />Supervision and control of such volunteers shall be the exclusive responsibility of <br />said Concessionaire. <br />5. <br />Provide proper supervision and instruction to any Concessionaire employees, if <br />any, and volunteers, including safety precautions for food service operations. <br />6. <br />Refuse to allow participation by any person whose employment or volunteers <br />services have not been authorized by Concessionaire. <br />7. <br />Concessionaire shall be responsible for maintaining the inventory of all food <br />service supplies and equipment at its own costs. Concessionaire shall reasonably <br />• <br />determine, from time to time, whether new equipment is needed. Concessionaire <br />shall be responsible for supplying all such necessary equipment, the purchasing <br />thereof, and paying for said equipment in full. Upon the termination of this <br />Agreement, Concessionaire shall be responsible for removal of its <br />equipment and in no event shall Concessionaires equipment be deemed <br />fixtures of the facility or property owned by the City. <br />8. <br />Obtain approval from the Recreation Commissioner prior to making changes, <br />alterations, improvements, or additions to the licensed concession area. All such <br />improvements or alterations are fixtures, and shall remain property of the City. <br />9. <br />Insure that any and all food service license and the equipment are inspected and <br />certified in writing on an annual basis by County Health Inspectors and immediately <br />provide written notification of said inspection results to the City. Concessionaire <br />shall take immediate remedial action and report to the City. <br />10. <br />Obtain and maintain general liability insurance for food seWise epeFat ons with <br />policy limits of one million/two million and which names the City of North Olmsted <br />as "an additional Insured" party and provides the City with notice of cancellation. <br />Copy and file certificates with City. Concessionaire also agrees to indemnify <br />and hold the City harmless from any and all claims arising from the food <br />service operations of any kind whatsoever, including any costs or damages <br />related thereto. <br />11. <br />Only in the event that Concessionaire determines to hire employees, then <br />• <br />Concessionaire shall obtain and maintain workers compensation insurance for <br />
