• food service operations and all employees of contractor. Copy and file certificates <br />with City. <br />12. Concessionaire shall disclose to customers, in conjunction with food service <br />operations, via signage approved by the City, that it is an independent contractor <br />of the City. <br />The City shall: <br />1. Make the concession area available for Concessionaire use during all hours when <br />the Recreation Complex is open. Specifically, the concession area or space <br />described by specifications and contract proposal. The City will be entirely <br />responsible for maintenance of and any improvements to the building and its <br />facility, with the exception of the food service equipment owned and maintained by <br />Concessionaire. <br />2. Be responsible for cleaning all common areas, including trash removal and <br />cleaning all Floor areas. <br />3. The City of North Olmsted shall post signage in conspicuous locations that <br />discloses that the Concessionaire is an independent contractor of the City. <br />Section IV <br />Duration of Contract <br />The term of this agreement shall be for a period commencing September 1, 2023 and <br />terminating on May 24, 2024. The City and Concessionaire reserve the right to <br />terminate this Agreement at anytime, thereby and Ile th9F9by revoking the <br />Concessionaire's license to access the designated spaces (concession area) for the <br />purposes of this Agreement. Absent emergency circumstances that may warrant <br />immediate termination without prior notification by the City, each party agrees to <br />provide the6enseeaienaire the other thirty (30) days advance written notification of <br />such unilateral termination and revocation. <br />Section V <br />Payment; Property Ownership <br />The Concessionaire shall pay the City $200 per month. Payment is to be made on a <br />monthly basis during the term of this Agreement. Payment is due on the 181 of each month <br />and shall be directed to the City in such form of delivery as required by the Recreation <br />Commissioner and approved by the Director of Finance. Concessionaire's failure to pay <br />shall be immediately reported to the Mayor and, if not cured, shall result in immediate <br />termination of this Agreement and revocation of this license to access and use the <br />concession area. The City shall, at all times, remain the owner of the concession area <br />and shall remain in control of the premises. Nothing in this Agreement shall grant or <br />0 <br />
