ARTICLE 40 INCLEMENT WEATHER <br />40.01. During periods of inclement weather, the Employer will attempt to schedule work that <br />does not require extensive exposure to the elements. Inclement weather is defined to mean air <br />temperature in excess of 100 degrees and air temperature below five degrees. During an <br />"emergency" as defined within Article 44, Section 1 of this agreement, the provisions of this <br />article shall not be applicable. <br />ARTICLE 41 FUNERAL LEAVE <br />41.01. Amount/Timin2. A full-time employee shall be granted a five (5) calendar days leave of <br />absence with pay, in the event of the death of an immediate family member, which must be <br />taken in conjunction with the date(s) of deathIfuneraUservice. Documentation may be <br />required to substantiate the requested leave. <br />41.02. Immediate Family Defined Immediate family shall include, spouse, children, step <br />children, father, mother, brother, sister, brother-in-law, sister-in-law, mother-in-law, father-in- <br />law, grandparents, grandchildren, step parents, step parents of spouse, son-in-law, daughter-in- <br />law, and grandparents of spouse. <br />41.03. Other Leave Use/Other Relationships. In the event of death of any other person not <br />listed above an employee shall use his accumulated sick leave or may use sick leave to extend <br />funeral leave time. <br />ARTICLE 42 COMMERCIAL DRIVER'S LICENSE <br />42.01. Employees in classifications which require a commercial driver's license (CDL) shall be <br />required to maintain a CDL. Employees transferring into or promoting into these classifications <br />shall have ninety (90) days to obtain a CDL. <br />42.02. The Employer shall pay the cost of the commercial driver's license, any endorsements to <br />that license, and any testing necessary to obtain it for all new employees required to obtain the <br />license to perform their duties, and all employees promoted to such positions. The Employer's <br />obligation shall be limited to the first test an employee takes, and the Employer shall reimburse <br />Employees the cost of the CDL, renewals and endorsements. The Employer agrees to pay the <br />cost to renew all licenses. <br />42.03. In the event that an employee loses his CDL or is not successful in passing the CDL <br />exam, the Employer shall place the employee into another available job he is capable of <br />performing at his regular rate of pay, provided it falls within the new job's wage schedule, or at <br />the top of the new job's wage schedule if his regular rate of pay does not fall within the new <br />job's wage schedule. Such placement shall supersede lateral transfers, the posting procedure, and <br />work week or shift preference transfers. <br />42.04.
