In the event that the Employer determines that two (2) <br />or more employees have equal knowledge, skills, and abilities to perform the position, then the <br />most seniority employee shall be awarded the vacancy and should the employees have identical <br />seniority dates, then a coin flip shall determine the award In the event that the Employer <br />determines that no internal candidates possess the necessary knowledge, skills, and abilities to <br />perform the position, the Employer shall have the authority to commence an external hiring <br />process and consider outside candidates. If the union believes the employer determination has <br />been made in an arbitrary and capricious basis, it may file a grievance over the matter. <br />. Regular full- <br />time Clerical and Technical Unit personnel may bid on jobs in the Service Waste Water Unit <br />providing no eligible employee within that unit has bid on thejob. Job postings for Service/Waste <br />Water unit positions will be posted at the bulletin board locations cited in Article 5. Employees <br />awarded such jobs will be given an opportunity to qualify pursuant to Article 14, Section 3.
