6.4 Provided the City is a state funded Employer with the Bureau of Workers' <br />Compensation any bargaining unit member who qualifies for benefits under this section shall be <br />required to pay over to the City any amount received from the Bureau of Workers' Compensation <br />as supplemental wages. Further, if at any time the City determines on the basis of medical evidence <br />that the employee is permanently disabled and will no longer be able to carry on his/her duties, <br />then the City may terminate payments and insist that the employee go on a pension program. <br />6.5 Any employee that qualifies for the benefits under this Section shall not have <br />his/her accumulated sick time reduced because of a qualified illness which occurred while in the <br />line of duty. <br />6.6 In the event that an employee has been injured or exposed to a toxic substance or <br />to an infectious disease in the course or scope of his/her employment and is sent to the hospital for <br />testing, treatment and/or preventative measures, and Workers' Compensation subsequently <br />determines that there is no injury sustained, all bills pertaining to the employee's testing, treatment <br />and/or preventive measures shall be the responsibility of the City of North Olmsted. <br />20 <br />4663-1214-9430, v.2 <br />
