31.94 23.08. Interview Parameters/Timing. Any interrogation, questioning or interviewing of an <br />employee will be conducted at hours reasonable related to his shift, preferable during his working <br />hours. Interrogation sessions shall be for reasonable periods of time with time allotted for attending <br />to physical necessities. <br />214713.09. Interview Recording/Conies. At the request of either party, interviews, or portions <br />thereof with an employee, conducted during the course of an inquiry may be tape recorded (audio). <br />In the case of an internal investigation, such interrogation shall be recorded by the police <br />department at the request of either party. A copy of the tape will be made available to the FOP. <br />31.98 23.10. , The violation <br />shall be noted and may be presented to the person or the court that will be making judgment on <br />the case that is presented. <br />ARTICLE Y4M 24 <br />LAYOFF/RECALL <br />=.91 24.01. Notice. Whenever the Employer determines a layoff is necessary due to lack of <br />funds, lack of work or that a reorganization in the operations of the Employer is necessary, a <br />reduction in force, Le., a layoff or abolishment of positions shall occur. The Employer shall <br />notify the affected employees in writing at least thirty (30) days in advance of the effective date of <br />layoff. <br />32.2 14.02 Order of Layoff/Displacement Rights. The Employer will determine in which <br />classification(s)1rank(s) a reduction is to be made, and within the affected classification rank, <br />the employee(s) with the least time in rank within the effected classification will be the first laid <br />off. Employees who are laid off may displace (bump) another employee with the least seniority <br />in a lower rated job classification within the bargaining units of patrolmen, sergeants, lieutenants, <br />and captains. Employees who are displaced (bumped) by a more senior employee shall be able to <br />displace (bump) another employee with the least less seniority in a lower rated job classification <br />within the bargaining unit. At the end of the bumping process, the employee who is displaced <br />(bumped) and unable to displace (bump) another employee (meaning that the patrolman with the <br />least amount of continuous, full-time service as a sworn police officer with the City of North <br />Olmsted) pursuant to the above provisions shall be laid off. <br />A. "Time in Rank" in terms of seniority, as used herein, shall mean the date continuous service <br />began in a rank classification. For purposes of calculating time in rank seniority and <br />bumping rights, any employee attempting to displace from lieutenant to sergeant shall <br />displace the sergeant with the least senior time in grade and be deemed at that point to <br />be the most senior sergeant. If a sergeant is attempting to displace into the rank ofpatrol <br />during this process, he will displace the least senior patrol officer and be placed on the <br />seniority list for patrolman based on the total amount of continuous full-time service as <br />a sworn police officer with the City of North Olmsted <br />B.
