An agenda will be famished upon request of either party at least five (5) working days in advance of the scheduled meetings with a list of the matters to be taken up in the meeting, and the names of those FOP representatives who will be attending. 24.93 26.03. It is further agreed that if special Labor/Management meetings have been requested, and mutually agreed upon, they shall be convened as soon as feasible. ARTICLE _.194 27 COMMUNICABLE DISEASES 23.81 27.01. The parties hereto agree that the duties of the employees are such that said employees are exposed to disease as a result of their assigned duties, it is the intention of the parties to provide to said employees salary continuation benefits when an employee contracts an illness as herein after specified. Any time the Governor or Mayor declare a state of emergency the Employer shall take all measures to equip members with protective gear, as recommended by the CDC, necessary to assist them with fulfilling their duties. The cost of this protective gear shall be the Employer's responsibility. 23.127.02. In the event that a full-time employee of the bargaining unit should become ill due to contact with AIDS, HIV, Hepatitis, Tuberculosis, MRSA, Meningitis, COVID or other communicable disease, and such illness has so incapacitated the employee that he temporarily is unable to work; the Police Chief shall investigate and determine whether the illness is work related. The Police Chief shall then forward his finding to the Safety Director who shall determine the nature and extent of the illness and how contracted, including circumstances thereof If after consideration of the totality of the facts the Safety Director determines that said disease was contracted during employment and may require medical leave, the Safety Director shall authorize the full payment of the employee's regular salary by the Employer for a period of ninety (90) days. This continuation of payment shall not be deducted from any of the Employee's accumulated time banks. 23.93 27.03. If atter ninety (90) days an illness still incapacitates the employee, the Safety Director shall recommend to Council whether to continue their salary for a successive ninety (90) day period or parts thereof Council shall forthwith review the matter and by a majority vote determine whether the employee shall continue to receive full salary during recuperation. Further, if at any time, the Employer determines on the basis of medical evidence that the employee is permanently disabled and will no longer be able to carry on his duties, then the Employer may terminate payments and insist that the employee go on a pension program. Any employee that qualifies for the benefits under this section shall not have his accumulated sick time reduced because of a qualified illness which occurred while in the line of duty. 30 4889-1582-5151. v.3
