You will have up to five minutes. <br />Jim Burns: <br />Jim Burns, B -U -R -N -S, 3978 Dover Center Road. I'm here a little bit confused on Ordinance <br />number 2024-53. During the Committee Meeting, when we were talking about the <br />definition of a thrift store, the Law Director read a definition which, I was only like half <br />listening to, which was my fault, but when he was finished, he said that the basic change <br />had to deal with how the merchandise was priced, which was fine with me. I had no <br />problem with that. I don't know if Council had a written copy of that amendment to read <br />through as he was presenting it or not. I did not. This weekend, I received a copy of the <br />amended ordinance, and I was able then to read the new definition of a thrift store, and as <br />you may remember, part of that ordinance, there's two paragraphs in the definition. One is <br />the definition, and one is an exemption for resale shops. The new definition of the thrift <br />store is the same as a resale shop now. What's missing is that phrase "through donations". <br />The original definition of a thrift shop was that this merchandise would be received through <br />donations, and then sold to the public. But the resale, and the current thrift shop definition, <br />does not say that. It says it gets its merchandise through the normal channels that stores get <br />their merchandise. So that confuses me, because if a thrift shop, if a resale shop is exempt <br />from the thrift shop part of the zoning code, then the thrift shop, by the same definition, is <br />the same as a resale shop, and anything in the business section where the definition of the <br />resale shop is, the thrift shop would be now part of that. So it seems to me like there's a <br />little conflict here that could be solved by simply putting back into this definition "through <br />donation". <br />Law Director Gareau: <br />Mr. President. Mr. Burns did reach out to me early this afternoon. I'd hoped to meet with <br />you before the meeting to talk this over, but I see you got here about three minutes after <br />the meeting started. I do agree with Mr. Burns with that definition also. I <br />know at the Planning Commission meeting that was discussed also, about being donations <br />and whatever.
