SECTION 5. If an employee is terminated (voluntarily or involuntarily) prior to taking his <br />vacation and has completed one (1) year of employment with the Employer, he shall receive the <br />prorated portion of any accrued but unused vacation at the time of separation. In case of death of <br />an employee, the unused vacation leave shall be paid to the estate. <br />SECTION 6. Vacation Scheduling/Notice/Personal Day Use with Vacation. <br />(a) An employee may have the option of using a personal day as a day of extended vacation, <br />with prior approval of the Chief of Police or his designee. <br />(b) Increments for Use/Nofice. An employee may have the option of using one week of his <br />vacation in increments of less than one week; for example, one or two days at a time. An <br />employee will give the supervisor at least forty-eight (48) hours advance notice in writing. <br />In an emergency situation verbal communication with the Supervisor is appropriate and <br />may justify waiving advance notification. <br />SECTION 7. Lateral Transfers. Employees having prior service may receive vacation with pay <br />based upon the above schedule and receive credit for years of prior service credit accepted by the <br />City, including but not limited date of transfer to the City, as set forth in Section 1. This provision <br />for Laterals Transfers shall affect vacation only and shall not alter the date of hire or seniority of <br />said employees relative to any other benefits or preferences, particularly with respect to scheduling <br />of vacations or other time off to be determined by the Chief of Police. <br />ARTICLE 4J 18: <br />SICK LEAVE <br />SECTION 1. An employee shall be granted sick leave for personal illness or injury as follows: <br />a) Accumulation. Paid sick leave shall be earned and accumulated at the rate of four and six - <br />tenths (4.6) hours for every eighty (80) hours paid, excluding overtime and may accumulate <br />such sick leave to an unlimited amount; <br />b) Rate ofPay. Pay for sick leave shall be at the employee's straight time hourly rate (or <br />portion thereof if absent for less than a full day); <br />c) Docia entatiomferiodic Record Review. If an employee is absent on sick leave for more <br />than three (3) consecutive work days, the Employer shall require the employee to present <br />a pkysisian's medical practitioner's report attesting to the employee's incapacity and that <br />the employee was under a deeters medical practitioner's cue and is able to return to work. <br />The Employer will review the attendance records of employees periodically and at least <br />once in each three (3) month period. If it believes that an employee is developing an <br />attendance problem, it will notify the employee in writing that credible medical evidence <br />will be required for absences of three (3) days or less.
