terminate payments and insist that the employee go on a pension program. <br />Any employee that qualifies for the benefits under this section shall not have his <br />accumulated sick time reduced because of a qualified illness which occurred while in the line of <br />duty. <br />In the event that an employee has been injured or exposed to a toxic substance or to an <br />infectious disease in the course or scope of his employment and is sent to the hospital for testing, <br />treatment and/or preventative measures, and Workers' Compensation subsequently determines <br />that there is no injury sustained, all bills pertaining to the employees testing, treatment and/or <br />preventative measures shall be the responsibility of the Employer. <br />ARTICLE 33: <br />COMPENSATORY TIME/SCHEDULING TIME OFF <br />SECTION 1. CmnpensatprV Time. Employees may take compensatory time when the time off <br />does not interfere with the operation of the Police Department The taking of such compensatory <br />time shall be subject to the approval of the Police Chief of his designee. Compensatory time <br />shall be taken in a one (1) hour minimum block and thereafter half (1/2) hour increments, <br />except at the start or end of a shift Half (1/2) hours increments may be used at the start or end <br />of a shift <br />SECTION 2. Reauest/Approval Procedure. Employees shall allow at least forty-eight (48) <br />hours' notice, except in an emergency situation, with regard to taking compensatory time off. <br />The Employer at its discretion may waive the forty-eight (48) hour notice requirement Where <br />an employee has put in for compensatory time off at least five (5) days in advance of the date <br />sought and where the coverage to receive the day off has been verified later, such time off will <br />not be cancelled after being approved <br />The parties agree that where an employee has been denied the usage of compensatory time on <br />a specific date, he may be offered an alternative day for compensatory time usage within the <br />next thirty (30) days, be offered cash payment for the amount of hours denied, or the employee <br />may withdraw his request for usage. It is the employee's choice in electing any of the offerings. <br />The parties specifically agree that thirty (30) days constitutes a reasonable time period for <br />satisfying a request for compensatory time usage under the Fair Labor Standards Act Except <br />as otherwise specifically restricted by this Agreement, the Employer retains all rights to manage <br />32 <br />4862-1615-2807, v.5 <br />
