Mayor Jones:
I'm unaware of how their process is but yes, it was strictly within their purview, I guess, to make
some of these determinations.
Jeff Sturgeon:
Could it be challenged in a Court of Law?
Law Director Gareau:
I haven't looked into something like that. If it can be challenged, I'm reasonably certain at some
point in the very near future there'd be some challenges being raised by entities far larger than
North Olmsted, that are going to be affected and far [worse], we're affected, but there are
going to be other entities that are affected in a far greater way than we are. I have not heard
anything out there about anybody perfecting a legal challenge. Presuming that they followed
the appropriate rule making authority, which they usually do. You would wonder if there would
be much of an ability for you to be able to challenge that, but I have not heard anybody
initiating a challenge to this, and I haven't looked into to determine if there would be grounds
to do so.
Jeff Sturgeon:
And again when Mr. Kearney is speaking with ODOT, could you remind them maybe about the
sidewalk program that we have to see if they would like to sign up for it?
Mayor Jones:
Yes, Mr. President to Mr. Sturgeon, yes, absolutely.
Council President Brossard:
Seeing no other comments from the audience, we will now move into legislation.
Legislation
Council Clerk:
Legislation on third reading.
Resolution 2024102 introduced by Mayor Jones. A Resolution approving the Northeast Ohio
Advanced Energy District Commercial -Industrial Program project plan and the Northeast Ohio
Advanced Energy Special Improvement District Commercial -Industrial Program services plan.
Councilman Limpert:
Mr. President.
Council President Brossard:
Councilman Limpert.
11-19-24 Council Meeting Minutes - Page 12
