CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2024 - 120 <br />BY: Mayor Jones <br />AN ORDINANCE AUTHORIZING AND RATIFYING EMERGENCY <br />REPAIR SERVICES PERFORMED BY CHIEFTAIN TRUCKING & <br />EXCAVATION, INC ON STORMAND SANITARYSEWERS ON GRACE <br />ROAD, AND DECLARINGANEMERGENCY. <br />WHEREAS, during the course of private party right-of-way excavation on Grace <br />Road, multiple deficiencies were detected on the storm and sanitary sewer systems under the <br />control of the City of North Olmsted on Grace Road; and <br />WHEREAS, under the direction of the City Engineer who determined the work <br />necessary and reasonable in price, emergency repair services were obtained for an amount <br />($64,000.00) — an amount under the City of North Olmsted's required bid threshold <br />($75,000.00) with Chieftain Trucking and Excavation, Inc.; and <br />WHEREAS, after several unforeseen delays due to repeated water line leaks under the <br />control of the City of Cleveland, a change order was presented to the City in the amount of <br />$14,799.81, thereby bringing the total contract amount over the bid threshold; and <br />WHEREAS, the City Engineer has determined that these additional fees are necessary, <br />reasonable andjustified; and <br />WHEREAS, the Charter of the City of North Olmsted at Article VIII, Section 6, <br />permits contracting without public bidding in the event of a "real and present emergency in <br />order to provide for the public health, safety, and welfare"; and <br />WHEREAS, the acquisition of emergency services to repair structurally compromised <br />storm and / or sewer lines only discovered during unrelated excavation work is a real and <br />present emergency justifying entering into a contract with Chieftain Trucking & Excavation, <br />Inc.; and <br />WHEREAS, it is the desire of this Council to ratify this contract and authorize the <br />Mayor to enter into a contract on behalf of the City of North Olmsted with Chieftain Trucking <br />& Excavation, Inc., as a real and present emergency exception to public bidding, necessary to <br />provide for the immediate preservation of public health, safety and welfare. <br />
