3. Additions or expansion of existing buildings of less than three thousand square feet <br />(3,000 s.f.) may be developed under the applicable regulations of this Overlay District <br />or under the regulations of the base zoning district, at the discretion of the applicant. <br />4. Any change in the Principal Use shall enact the requirements of this Chapter. <br />B. Relationship to Other Development Standards. All of the provisions of this Zoning Code <br />that are applicable to the underlying Base district shall apply, except as specifically <br />modified in this Chapter. <br />C. Transitional Regulations. The following transitional regulations will resolve the status of <br />properties with pending or approved applications at the time of adoption of this Chapter: <br />Pending Applications. <br />a. Any complete application that has been accepted and placed on an agenda for <br />review by the Planning and Design Commission for approval, but upon which <br />no final action has been taken by the Planning and Design Commission prior <br />to the Effective Date of this Chapter, shall be reviewed in accordance with the <br />provisions of the underlying zoning district in effect on the date the application <br />was deemed complete and placed on the Planning Commission's agenda. <br />b. Amendments to completed applications that meet the definition of Major <br />Changes as identified in Section 1126.08 Amendments to Development Plans, <br />shall require the application to be subject to the requirements of this Chapter. <br />C. If the Applicant fails to comply with the requirements of Section 1126.09 <br />Expiration and Extensions, the approval shall expire and subsequent <br />applications shall be subject to the requirements of this Chapter. <br />d. Any reapplication for an expired project approval must meet the standards in <br />effect at the time of reapplication. <br />e. An Applicant with a pending application may elect to have the project reviewed <br />under the regulations of this Chapter through a written letter to the Economic <br />& Community Development Director requesting review under the provisions of <br />this Chapter. <br />2. Approved Projects. <br />a. Approved site plans, variances, Conditional Use approvals, or building permits <br />that are valid on the Effective Date of this Chapter shall remain valid until their <br />expiration date, where applicable. <br />b. Plans approved under the previous regulations that are valid on the Effective <br />Date of this Chapter shall also remain valid until their expiration date, where <br />applicable. <br />JANUARY 24, 2025 <br />
