<br />therein. Such parking violations thereafter shall be subject to the penalties provided
<br />in this chapter, or if no specific penalty is provided for a section of this chapter,
<br />then in accordance with Section 303.99.
<br />SECTION 2: That, in all other respects, the North Olmsted Code, as amended and
<br />supplemented from time to time, shall remain in full force and effect.
<br />SECTION 3: That all other ordinances or parts of ordinances or resolutions that
<br />are inconsistent or in conflict with the newly amended and adopted sections are likewise
<br />repealed to the extent of such inconsistency or conflict only.
<br />SECTION 4: That, if any section, paragraph, sentence, clause, phrase, term,
<br />provision or part of this Ordinance shall be adjudged by any court of competent jurisdiction
<br />to be invalid or inoperative, such judgment shall not affect, impair or invalidate the
<br />remainder thereof, but shall be confined in its operation to the section, paragraph, sentence,
<br />clause, phrase, term, provision or part thereof directly involved in the controversy in which
<br />such judgment shall have been rendered.
<br />SECTION 5: That this Ordinance is hereby declared to be an emergency measure
<br />immediately necessary for the preservation of the public health, safety and welfare, and for
<br />the further reason that the City is in litigation regarding its parking ticket procedures and
<br />the immediate amendment of parking procedure will support the City's defense and
<br />settlement of claims; and further provided it receives the affirmative vote of two-thirds of
<br />all members of Council, it shall take effect and be in force immediately upon its passage
<br />and approval by the Mayor.
