CITY OF NORTH OLMSTED ORDINANCE NO. 2005 - 96 BY: Mayor O'Grady AN ORDINANCE AMENDING SECTION I OF ORDINANCE NO. 2004 -63 IN ORDER TO AUTHORIZE ANNUAL CONTRACT AMOUNT INCREASES NOT TO EXCEED TEN PERCENT PER YEAR FOR THE BUILDING DEPARTMENT'S ICESIICES MOBILE ANNUAL MAINTENANCE CONTRACT WITH COMPUHENSIVE BUSINESS SOLUTIONS, INC., AND DECLARING AN EMERGENCY. WHEREAS, pursuant to Ordinance No. 2004 -63, adopted on April 20, 2004, this Council authorized the Mayor to dispense with the RFP procedures provided in Section 111.03 et seq. of the City Administrative Code, and enter into a personal services contract with Compuhensive Business Solutions, Inc. (hereinafter, "CBS ") in order to authorize this vendor to continue to provide the ICES maintenance services to the North Olmsted Building Department that it had been providing to the Building Department, without express Council contract authorization, since 1996; and WHEREAS, said Ordinance, as adopted, provided for a maximum contract expenditure of Two Thousand Three Hundred Eighty -Eight ($2,388.00) Dollars; and WHEREAS, CBS advised the Building Department in May 2005 that the said maintenance contract, which provided for an initial one -year term with automatic one -year renewals unless timely terminated by the City, had automatically renewed for a new one -year term of June 1, 2005 through June 1, 2006, and that the annual contract amount for said new term had increased, as provided for in the said contract, by approximately ten percent (10 %) to Two Thousand Six Hundred Eighteen Dollars ($2,618.00); and WHEREAS, the increased contract amount for the new June 1, 2005 through June 1, 2006 term is greater than the maximum contract expenditure authorized by this Council in Ordinance No. 2004 -63; and WHEREAS, based upon the recommendation of the Building Commissioner that it requires the services provided by this Vendor to successfully operate the Building Department, and the increase for the renewed June 1, 2005 -June 1, 2006 term is not unreasonable, it is the desire of this Council to amend Section 1 of Ordinance No. 2004 -63 to permit the Building Department to pay said increased contract amount for the renewed term and to further permit future automatic renewals of this maintenance contract so long as the annual contract expenditure does not increase by more than ten percent (10 %) in any renewed term; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: SECTION 1: That Section 1 of Ordinance No. 2004 -63, which currently reads as follows:
