CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2005 - 96 <br />BY: Mayor O'Grady <br />AN ORDINANCE AMENDING SECTION I OF ORDINANCE NO. 2004 -63 <br />IN ORDER TO AUTHORIZE ANNUAL CONTRACT AMOUNT INCREASES <br />NOT TO EXCEED TEN PERCENT PER YEAR FOR THE BUILDING <br />DEPARTMENT'S ICESIICES MOBILE ANNUAL MAINTENANCE <br />CONTRACT WITH COMPUHENSIVE BUSINESS SOLUTIONS, INC., AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to Ordinance No. 2004 -63, adopted on April 20, 2004, this Council <br />authorized the Mayor to dispense with the RFP procedures provided in Section 111.03 et seq. of <br />the City Administrative Code, and enter into a personal services contract with Compuhensive <br />Business Solutions, Inc. (hereinafter, "CBS ") in order to authorize this vendor to continue to <br />provide the ICES maintenance services to the North Olmsted Building Department that it had <br />been providing to the Building Department, without express Council contract authorization, <br />since 1996; and <br />WHEREAS, said Ordinance, as adopted, provided for a maximum contract expenditure <br />of Two Thousand Three Hundred Eighty -Eight ($2,388.00) Dollars; and <br />WHEREAS, CBS advised the Building Department in May 2005 that the said <br />maintenance contract, which provided for an initial one -year term with automatic one -year <br />renewals unless timely terminated by the City, had automatically renewed for a new one -year <br />term of June 1, 2005 through June 1, 2006, and that the annual contract amount for said new <br />term had increased, as provided for in the said contract, by approximately ten percent (10 %) to <br />Two Thousand Six Hundred Eighteen Dollars ($2,618.00); and <br />WHEREAS, the increased contract amount for the new June 1, 2005 through June 1, <br />2006 term is greater than the maximum contract expenditure authorized by this Council in <br />Ordinance No. 2004 -63; and <br />WHEREAS, based upon the recommendation of the Building Commissioner that it <br />requires the services provided by this Vendor to successfully operate the Building Department, <br />and the increase for the renewed June 1, 2005 -June 1, 2006 term is not unreasonable, it is the <br />desire of this Council to amend Section 1 of Ordinance No. 2004 -63 to permit the Building <br />Department to pay said increased contract amount for the renewed term and to further permit <br />future automatic renewals of this maintenance contract so long as the annual contract <br />expenditure does not increase by more than ten percent (10 %) in any renewed term; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: That Section 1 of Ordinance No. 2004 -63, which currently reads as <br />follows: <br />
