'. <br />i� Id's <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2005- 27 <br />BY: Council Members Miller, McKay, Nashar and Kasler <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NOR THOLMSTED OFAN <br />AMENDMENT TO SECTIONS 1, 2 AND 3 OF ARTICLE IT , <br />AND SECTIONS 2 AND 4 OFARTICLE IX, OF THE CHARTER <br />OF THE CITY OF NOR TH OLMSTED TO PRO VIDE FOR THE <br />PRESIDENT OF COUNCIL TO BE A MEMBER OF COUNCIL <br />APPOINTED BY A MAJORITY OF THE MEMBERS OF <br />COUNCIL, RATHER THAN A SEPARATELY ELECTED <br />OFFICE, AND DECLARING AN EMERGENCY, AS TWICE <br />AMENDED. <br />WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a <br />proposal to amend Sections 1, 2 and 3 of Article IV, and Sections 2 and 4 of Article IX, of the <br />Charter so as to provide for the President of Council to be a member of Council appointed by a <br />majority of the members of Council, rather than a separately elected office; and <br />WHEREAS, this proposal was submitted by this Council to the Charter Review Commission <br />for review and recommendation in accordance with Article XIV, Section (b)(2) of the City Charter, <br />and, within 60 days of the date of referral, the Commission on the 17th day of May, 2005, filed a <br />written report with the Clerk of Council in which the Commission stated that, by a 3 -2 vote, a motion <br />to recommend approval of the proposal failed; and <br />WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner <br />than 120 days, and no later than 60 days, prior to the date of the election at which the issue will be <br />voted upon by the electorate; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, OHIO, TWO - THIRDS OFALL MEMBERS <br />CONCURRING THAT: <br />
