CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2005 — 25 <br />BY: Councilman Michael Gareau, Jr. <br />AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER TO <br />PROCEED WITH THE DEMOLITION AND REMOVAL OF DANGEROUS <br />BUILDINGS LOCATED AT 4170 COLUMBIA ROAD, IN THE CITY OF <br />NORTH OLMSTED, AS A PUBLIC NUISANCE, AND FURTHER <br />AUTHORIZING THE COSTS TO BE CERTIFIED AS A TAX LIEN UPON <br />SAID PREMISES, PURSUANT TO SECTION 1331.05(e) OF THE <br />CODIFIED ORDINANCES, AND DECLARING AN EMERGENCY. <br />WHEREAS, both the Building Commissioner and the Board of Building Code <br />Appeals have determined that the buildings located at 4170 Columbia Road are both <br />dangerous and constitute a public nuisance as defined by NOCO § 1131.01 and 1331.03 <br />and, due to the extensive deterioration of these vacant and unsafe structures, have ordered <br />demolition and removal to abate the nuisance; and <br />WHEREAS, the Board of Building Code Appeals has proceeded in accordance <br />with NOCO § 1331.05 (c) & (d) with respect to notification, hearing dated December 22, <br />2004 and Order dated January 21, 2005, and has thereby provided the property owner, <br />lienholders or others having an interest in the property with notice of and an opportunity <br />to be heard on its determination of dangerous buildings, existence of nuisance conditions <br />and abatement by demolition; and <br />WHEREAS, although notified in accordance with NOCO § 1331.04(d) and <br />1331.05(d), said property owner, lienholders and others having an interest have failed to <br />comply with said multiple Orders to demolish these vacant and dangerous buildings, and <br />have failed to appear before the Board or otherwise object to the demolition Orders, and <br />have failed to appeal to Court from the decision of the Board, which is therefor final and <br />conclusive; and <br />WHEREAS, it is the desire of this Council, based upon the findings, proceedings <br />and Orders of the Board and in accordance with NOCO § 1331.05(e), to cause the <br />dangerous buildings located at 4170 Columbia Road in the City of North Olmsted to be <br />demolished and removed in order to abate the public nuisance arising therefrom and to <br />further cause the costs of demolition and removal to be certified and placed upon the tax <br />duplicate of the premises as a lien upon said premises; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />
