??. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007 - 72 <br /> <br />BY: Mayor O'Grady and Council Members Barker and Dailey Jones <br />AN ORDINANCE AMENDING SECTIONS 721.01, 721.03 AND <br />721.09, AND CREATING NEW SECTION 721.031, OF CHAPTER 721 <br />OF THE BUSINESS REGULATION CODE (PEDDLERS, <br />SOLICITORS AND CANVASSERS) IN ORDER TO CREATE A"DO <br />NOT KNOCK REGISTRY" AND TO UPDATE VARIOUS OTHER <br />PRO VISIONS OF THIS CHAPTER OF THE B IISINESS <br />REGULATION CODE, AS AMENDED. <br />WHEREAS, the City Administration and Members of Council have received <br />numerous complaints from residents that peddlers and solicitors often attempt to peddle <br />or solicit at the homes of residents even when the residents have posted "No peddling or <br />soliciting" notices at the entrances to their homes as provided for in Section 721.03(d) of <br />the Business Regulation Code; and <br />WHEREAS, it is the desire of this Council, in order to better inform peddlers and <br />solicitors of the identity of those residents who have clearly expressed a desire to have no <br />peddling or soliciting at their residences, to establish a"Do Not Knock Registry" and to <br />prohibit peddling or soliciting at those addresses where residents have expressly <br />requested that they be listed on the Registry; and <br />WHEREAS, it is further the desire of this Council to amend Sections 721.01 and <br />721.03 and 721.09, on the recommendation of the Director of Law, in order to bring these <br />sections, and Chapter 721 in general, into better conformance with current First <br />Amendment law; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That Sections 721.01, 721.03 and 721.09 of Chapter 721 of the <br />Business Regulation Code, which presently read in their entirety as set forth in the <br />current version of Chapter 721 of the Business Regulation Code (Peddlers, Solicitors and <br />Canvassers) which is attached to this Ordinance as Exhibit A and incorporated herein by <br />reference as if fully restated herein, be amended, and, as amended, shall read in their <br />entirety as set forth in new Chapter 721 of the Business Regulation Code (Peddlers, <br />Solicitors, and Temporary Businesses) attached to this Ordinance as Exhibit B and <br />incorporated herein by reference as if fully restated herein. <br />
