CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 -14 <br />BY: Council Member Dailey. <br />AN ORDINANCE PROIIIDING FOR THE AMENDMENT OF <br />THE ZONE MAP OF THE CITY OF NORTH OLMSTED BY <br />REZONING PERMANENT PARCEL NUMBER 231-26-005, <br />231-26-004, AND 231-26-403, LOCATED IMMEDIATELY TO <br />THE NORTH OF THE FORMER CUPACHINO'S BUILDING <br />ON THE NORTHWEST CORNER OF CLAGUE ROAD AND <br />LORAIN ROAD, FROM ONE FAMILY RESIDENCE TO <br />GENERAL RETAIL BUSINESS. <br />WHEREAS, this Council, upon the recommendation and review of the City Planner, <br />finds that rezoning Permanent Parcel Numbers 231-26-005, 231-26-004, and 231-26-003, from <br />one family residential district use to general retail business district use will further, and bears a <br />substantial relation to, the public health, safety, and welfare, and that said rezoning will promote <br />orderly development of a good general retail business use on these parcels of land as well as <br />upon the existing retail parcel located immediately to the south of these parcels, and will <br />generally well serve the interests of the North Olmsted community by encouraging a <br />development of uses needed within the community and which will improve the City's tax base; <br />and <br />WHEREAS, on the 23`d day of December, 2003, by formal motion, the Planning <br />Commission recommended the initiation of this Ordinance, proposing to rezone Permanent <br />Parcel Nos. 231-26-005, 231-26-004, and 231-26-003 from C One Family Residence District use <br />to General Retail Business District use; and <br />WHEREAS, following publication of newspaper notice and notice to the record title <br />holders of real property located within one thousand (1,000) feet of the property proposed to be <br />rezoned, a public hearing was held, in conformance with the provisions of Section 14 of Article <br />IV of the Charter and Section 1127.03 of the Zoning Code, on the ? day of , <br />2004; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Zone Map of North Olmsted is hereby amended, and, as amended, <br />shall depict and state that the zoning of the following described paxcel of land located within the <br />City, to-wit: Permanent Parcel Numbers 231-26-005, 231-26-004, and 231-26-003, located on <br />
