CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 -17 <br />BY: Council Member Gareau <br />AN ORDINANCE AMENDING SECTION 111.02 OF <br />CHAPTER lll OF THE ADMINISTRATIVE CODE, <br />ENTITLED "CITY CONTRACTS" IN ORDER TO REQUIRE <br />THE CITY'S CONTRACTORS TO DISCLOSE <br />INFORMATION RELATING TO PAST LITIGATION <br />INVOL VING CLAIMS BY OR AGAINST THE CONTRACTOR <br />WHEREAS, this Council believes that, in selecting contractors for the City's <br />competitively bid contracts involving improvements to the City's buildings, streets and rights-of- <br />way, it is important and relevant to acquire and review information relating to civil actions, <br />arbitration demands, and liens filed by or against such contractors; and <br />WHEREAS, it is the desire of this Council to accordingly amend Section 111.02 of <br />Chapter 111 of the Administrative Code, entitled "City Contracts," in order to require City <br />Contractors to disclose, in addition to other relevant information presently required by the said <br />section, specific information relating to such litigation-related history of contractors; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 111.02 of Chapter 111 of the Administrative Code, entitled <br />"City Contracts," which presently reads as follows: <br />"111.02 MANDATORY MINIMUM CONTRACTING STANDARDS RELATING <br />TO BIDDER RESPONSIBILITY. <br />(a) In connection with the public bidding and contract awarding process for every <br />proposed improvement to City real property, including, but not limited to, City buildings, streets, <br />and rights of way, for which bidding is required by law, the Director authorized to let bids for <br />said proposed improvement shall, prior to the letting of bids, establish criteria for evaluating <br />bidder responsibility and shall require that all bidders provide information necessary to ascertain <br />the pecuniary and financial responsibility, accountability, reliability, skill, capacity, judgment, <br />and integrity of each bidder to do business in the City. In the event that any bidder fails to <br />furnish the requested information and/or the information provided demonstrates a lack of <br />responsibility, such bidder shall be disqualified and rejected as not a responsible bidder. <br />(b) The Director shall require each bidder to minimally furnish the following items: <br />(1) Description of its experience with projects of comparable <br />size, complexity, and cost within recent years, demonstrating the <br />contractor's ability and capacity to perform a substantial portion of the <br />project with its own forces; <br />
