CITY OF NORTH OLMSTED ORDINANCE NO. 2000-22 BY.• MAYOR MUSIAL AN ORDINANCE AMENDING ORDINANCE NO. 93-21 WHICH AUTHORIZED THE MAYOR OF THE CITY OF NORTH OLMSTED TO PARTICIPATE IN THE OHIO DEPARTMENT OF TRANSPORTATION'S COOPERATIVE PURCHASING PROGRAM, AND DECLARING AN EMERGENCY. WHEREAS, the City of North Olmsted on March 16, 1993, adopted Ordinance No. 93- 21, which provided for the participation of the City in the Ohio Department of Transportation's Cooperative Purchasing Program; and WHEREAS, the State of Ohio has advised the Director of the Department of Service for the City that, in order to continue participating in the program, the City must amend its enabling legislation so as to further provide that the City will hold the Director of Transportation and the Ohio Department of Transportation harmless for any claim or dispute arising out of participation in a contract pursuant to Ohio Revised Code Section 5513.01(B); and WHEREAS, the City desires to continue participating in the said program, which enables the City to purchase machinery, materials and supplies at very competitive prices, and dces not find the new State requirement to be overly onerous; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION ONE: That Ordinance Number 93-21 which presently reads as follows: "SECTION 1: That the Mayor be and he is hereby authorized to participate in the Ohio Department of Transportation's contracts for the purchase of machinery, materials, supplies or other articles which the Department has entered into pursuant to Revised Code Section 5513.01(B). SECTION 2. That the City of North Olmsted, through the Mayor, is authorized to enter into an agreement with the Ohio Department of Transportation for the purposes of being bound by the terms and conditions of the purchasing process as is prescribed by the Director of the Department of Transportation.
