. <br />CITYOFNORTHOLMSTED <br />ORDINANCE NO. 99-113 <br />BY• COUNC7LMANPAUL 1N7T.T.F.R <br />.? ..? <br />AN O.RDINANGE AMENDING SECTION 1119.01 OF THE <br />NORTS OLMSTED ZONING CODE, ENTITLED "BUILDING <br />PERNI7T REQ UIRED, " IN ORDER TO PROHIBIT <br />COMMERCIAL AND NEW RESIDENTIAL DEYELOPERS <br />FROM OBTAINING BUILDING PERMITS FOR REAL <br />PROPERTY DEYELOPMENT WHEN REAL PROPERTY <br />TAXES AREDUE AND OWIIVG, AS THRICE AMENDED. <br />97iTF'RF.,4S, developers of real property in the City of North Olmsted should not be <br />entitled to the benefits of building permits for the improvement of real property where the <br />owners of such properties are not current in real property ta.xes due and owing; and <br />WHEREAS, this Council desires accordingly to prohibit commercial and new residential <br />developers from obtaining building permits for construction work on real property where the taxes <br />due and owing on said real property have not been paid, or arrangements have not been otherwise <br />made with the County Auditor for the payment of back taxes owed; and <br />RlAF.RF.,4S, it is the desire of this Council to amend the City Zoning Code to include the <br />provisions which follow herein conditioning the issuance of building permits for certain classes of <br />developers upon the payment, or formal arrangement for the payment, of all overdue taxes; and <br />WSEREAS, after careful consideration, the Planning Commission of the City, on the 28th <br />day of September, 1999, recommended approval of the following amendment to the Zoning Code <br />in substantially the same form as this twice amended version of the Ordinance; <br />NOW, TSEREFORE, BE IT ORDAINED BY TSE COUNCIL OF TTREE QTY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF O.HIO: <br />SECTION 1: That Section 1119.01 of the Zoning Code of the City of North Olmsted, <br />which presently reads as follows: <br />
