? <br />? <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 99-74 <br />BY: COUNCII.WOMAN KASLER <br />A RESOL UTION OPPOSING AMENDED HOUSE BILL 101 (AM.H.B. 101) <br />WHICH WOULD PROHIBIT PUBLIC AUTHORITIES FROM REQ UIRING <br />THAT SUCCESSFUL BIDDERS ONPUBLIC IMPROVEMENT PROJECTS <br />ADHERE TO PROJECT LABOR AGREEMENTS NEGOTIATED BY THE <br />PUBLIC A UTHORITY, AND DECLARING AN EMERGENCY AS AMENDED. <br />WHEREAS, Am. H.B. 101, which was passed by the Ohio House on May 12, 1999, and <br />is now pending in the Ohio Senate, would prohibit public authorities from requiring that <br />successful bidders on public improvement projects adhere to project labor agreements negotiated <br />by the public authority; and <br />WHEREAS, the prohibitions within Am. H.B. 101, as presently constituted, would apply <br />to chartered municipal corporations, such as the City of North Olmsted, when a public <br />improvement project included state funds appropriated for the purposes of that public <br />improvement project; and <br />WHEREAS, Am. H.B. 101 would further tend to promote litigation against public <br />authorities, including municipal corporations, and waste tax dollars, by providing a two-year <br />window of opportunity for "interested" parties to sue public authorities for violations of the Bill's <br />prohibitions, and enable such parties not only to obtain orders from courts of competent <br />jurisdiction voiding the public contracts, but also to receive awards of substantial attorney fees, <br />court costs and "other fees" incurred in the course of the law suit; and <br />WHEREAS, this Council believes that Am. H.B. 101 represents an attempt by the State to <br />interfere with matters which are purely local in nature and which should not be the subject of state <br />legislation; and <br />WHEREAS, this Council further believes that Am H.B. 101 represents legislation which <br />purports only to grant or limit the authority of municipal corporations to adopt and enforce local <br />police regulations within municipal boundaries and, as such, would violate the home rule <br />provisions of Article XVIII, Section 3 of the Ohio Constitution; and <br />WHEREAS, this Council presently has before it for its consideration proposed North <br />Olmsted Ordinance No. 99-54 which would impose a duty upon the Mayor of the City of North <br />Olmsted, under certain specified conditions, to negotiate project labor agreements with the <br />Cleveland Building and Construction Trades Council, and to require that the successful bidder on <br />certain North Olmsted public improvement projects adhere to the provisions of such negotiated <br />project labor agreement; and <br />
