CITY OF NORTH OLMSTED <br />ORDINANCE NO. 99 - 67 <br />BY.• COUNCILMAN DEAN MCKA Y <br />AN ORDINANCE AMENDING SECTION 901. 0 7 OF THE CODIFIED <br />ORDINANCES OF THE CITY OF NORTH OLMSTED, ENTITLED <br />"TREELA WN OPENINGS; PERMIT AND FEE" IN ORDER TO PROVIDE <br />FOR ALTERNATE METHODS AND MATERIALS FOR TREELAWN <br />BRICKSCAPE.S, AND DECLARING AN EMERGENCY, A.S AMENDED. <br />WHEREAS, the existing Section 901.07 requires brick pavers to be installed in <br />treelawns when a new commercial building or an addition to a commercial building is to be <br />constructed and the work will disturb the treelawn area; <br />WHEREAS, it has been proposed by architects to substitute colored concrete which <br />would be impressed with a mold in order to simulate brick pavers; and <br />WHEREA.S, the current ordinance does not specifically permit this method and material <br />as an alternate but such installation can have a better appearance and less maintenance; and <br />WHEREAS, the City Engineer recommends the use of colored concrete to simulate brick <br />pavers; and <br />WHEREAS, this Council accepts the recommendation of the City Engineer and desires to <br />enact legislation consistent with the recommendation of the City Engineer; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 901.07 of the Codified Ordinances of the City of North Olmsted, <br />Ohio, entitled "Treelawn Opening; Permit and Fee," which presently reads as follows: <br />"901.07 TREELAWN OPENINGS; PERMIT AND FEE. <br />(a) If an application is made for a permit to open a street in the area of the public sidewalk or <br />treelawn, then the applicant shall make the payment of thirty dollars ($30.00) for a permit and <br />shall deposit with the Finance Department thirty dollars ($30.00) per square yard based on <br />the size of the opening, as a guarantee that he will restore the sidewalk or the treelawn to its <br />original condition or pay the City for restoring the same. Such deposit, less the cost of <br />inspection, shall be returned to the person, firm or corporation making the same upon the <br />issuance of a certificate by the City Engineer that the treelawn ar sidewalk has been restored <br />to the same or better co»dition as befiore the opening was made. <br />
