?. <br />_- <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003 -148 <br />BY: COUNCILPERSON CAROLYNKASLER <br />AN ORDINANCE AMENDING CHAPTER 1139 OF THE <br />PLANNING AND ZONING CODE, ENTITLED `BUILDING <br />DISTRICTS,"IN ORDER TO PERMIT THE INSTALLATION <br />OF SHADE TREES WITHIN THE RIGHT OF WAY, <br />SPECIFICALLYAMENDING SECTION 1139.10. <br />WHEREAS, amendments of the Codified Ordinances of the City of North Olmsted are <br />necessary to permit and to encourage the placement of shade trees within the treelawn of streets, <br />particularly within the business districts, and are appropriate to improve the aesthetic appearance <br />of commercial areas; and <br />WHEREAS, this Council finds that the appearance of the City streetscape in commercial <br />areas would be improved by and commercial developments are enhanced by the installation of <br />shade trees, which may include the treelawn whenever practicable; and <br />N'HEREAS, it is accordingly the desire of this Council, based upon its own observations <br />and its own legislative findings, to amend the appropriate sections of Chapter 1139 of the <br />Planning and Zoning Code in order to provide for the installation of shade trees within the <br />municipal right of way upon the improvement of commercial properties; and <br />WHEREAS, the Planning Commission on , 2003, by formal <br />motion, (recommended - did not recommend) that this Ordinance, proposing amendment of <br />Chapter 1139 of the Planning and Zoning Code to require that commercial development plan <br />proposals address shade trees, be approved; <br />WHEREAS, following publication of newspaper notice, a public hearing was held, in <br />conformance with the provisions of Section 14 of Article IV of the Charter and Section 1127.03 <br />of the Zoning Code, on the day of , 2003; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />1VORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO. <br />??
