CITY OF NORTH OLMSTED RESOLUTION NO. 2003 - 95 BY: Mayor Musial A RESOLUTION AUTHORIZING THE MAYOR TO NOTIFY BROWNING-FERRIS INDUSTRIES OF OHIO, ING ("BFI"), OF THE CITY'S INTENTION TO TERMINATE ITS CONTRACT WITH BFI IN ORDER TO PREVENT AN AUTOMATIC EXTENSION OF THE CONTRACT; FURTHER AUTHORIZING THE MAYOR TO SOLICIT BIDS FOR THE CITY'S CONTRACT FOR THE COLLECTION AND DISPOSAL OF SOLID WASTE AND PROCESSING OF RECYCLABLE MATERIALS; FURTHER AUTHORIZING THE MAYOR, UPON APPROVAL OF THE BOARD OF CONTROL, TO ENTER INTO A CONTRACT WITH THE LOWEST AND BEST BIDDER; AND DECLARING AN EMERGENCY. WHEREAS, the current term of the City's contract with Browning-Ferris Industries of Ohio, Inc. ("BFI") for the collection and disposal of solid waste and processing of recyclable materials terminates on December 31, 2003; and WHEREAS, the said contract provides for successive automatic renewals if the City does not, within 120 days prior to the end of a term, notify the contractor of its intent to terminate; and WHEREAS, it is the recommendation of the Mayor that the City's contract for the collection and disposal of solid waste and processing of recyclable materials, which has not been competitively bid since 1996, be competitively bid this year in order to, if possible, effect cost savings in the contract; and WHEREAS, it is accordingly the desire of this Council to authorize the Mayor to notify BFI of the City's intent to terminate its contract with BFI so as to prevent an automatic extension of the contract; and WHEREAS, it is further the desire of this Council to authorize the Mayor to solicit bids for the City's contract for the collection and disposal of solid waste and processing of recyclable materials and, following approval of the Board of Control, to enter into a corrtract with the lowest and best bidder; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO:
