<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003 - 75 <br />BY: Mayor Norman T. Musial <br />AN ORDINANCE GRANTING TO THE CITY OF CLEVELAND <br />DIVISION OF WATER A LIMITED RIGHT OF WAY AND <br />EASEMENT WITHIN CERTAIN PROPERTY OWNED BY THE <br />CITY OF NORTH OLMSTED AT THE NORTH OLMSTED <br />LIBRARY FOR MAINTENANCE OF WATER METER VAULTS, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council has authorized the Mayor to enter into various agreements for the <br />construction of and to otherwise commence public improvements for the new North Olmsted Library; <br />and <br />WHEREAS, in order to implement said plans and in order to comply with regulations <br />administered by the City of Cleveland, Division of Water, it is necessary that the City grant an <br />easement for such utilities on city-owned land at the site of the new North Olmsted Library, so that <br />water supply services may be provided by the installation and maintenance of water meter vaults and <br />related facilities; and <br />WHEREAS, it is the intent of this Council that said easement be granted to the City of <br />Cleveland, Division of Water to allow access for and authorizing said utility to regulate the <br />installation and maintenance of water meter vaults upon lands owned by the City of North Olmsted; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor of the City of North Olmsted be and he is hereby authorized <br />and directed to execute an easement agreement, substa.ntially in the form of the agreement attached <br />hereto as Exhibit A, granting to the City of Cleveland, Division of Water, an easement for the purpose <br />of providing water supply facilities, together with such access upon and inspection of the installation <br />and maintenance of water meter vaults upon lands owned by the City of North Olmsted, as described, <br />and commonly known as the new North Olmsted Library. Said easement shall extend and continue <br />so long as such utility services are suppliel by Cleveland, or its successor or assigns, to the land for <br />said Library complex for the City of North Olmsted. <br />
