CITY OF NORTH OLMSTED ORDINANCE NO. 2003 - 70 BY: Council Member Gareau t# AN ORDINANCE AMENDING SECTION 950.02 OF CHAPTER 950 OF THE STREETS, UTILITIES AND PUBLIC SERVICES CODE ENTITLED "URBAN FOREST" TO REVISE CERTAIN DUTIES OF THE CITY FORESTER, AND DECLARING A1V EMERGENCY, AS AMENDED. N'HEREAS, it is the desire and intention of this Council, in conjunction with other proposed amendments to and supplementation of Chapter 950, "Urban Forest," to consider the expansion of the scope and duties of the City Forester; and WHEREAS, it is the recommendation of the Director of Law, in consideration of the proposed new procedure to obtain tree preservation/removal permit, in conjunction with development plans reviewed by the Architectural Review Board and Planning Commission, that amendments of North Olmsted Codified Chapter 950.02 are necessary and appropriate to provide for the arboricultural review and advice from the City Forester; and NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Section 950.02, which presently reads as follows, shall be amended as hereinafter provided in Section 2: 950.02 DU'TIES AND PUWER5 OF CITY FORESTER. The City Forester sha11 be vested with the following duties and powers: (a) To enforce or cause to be enforced the provisions of this cha.pter. (b) To enforce arboricultural specifications and standards of practice generally accepted by the arboriculture trade, which shall govern the selection, planting, maintenance, production and removal of public, commercial and multi-family residential trees and utilization of wood and forest products produced in the course of operation. (c) To issue orders and permits for planting, maintenance, protection and removal of public, commercial and multi-family residential trees. (Ord. 85-138. Passed 1-21-86.)
