<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003 - 47 <br />?.? <br />BY: COUNCILMAN GEORGE NASHAR & MICHAEL GAREAU, JR <br />AN ORDINANCE TO ESTABLISH A NEW AND REVISED PROCEDURE FOR <br />DEYELOPMENT PLAN REVIEW AND TO AUTHORIZE THE ASSESSMENT OF <br />COSTS FOR EXPERT CONSULTATION BY AMENDING SECTIONS 1126. 02, <br />1126. 03, AND 1126. 04(a) OF CHAPTER 1126 OF THE PLANNING AND ZONING <br />CODE ENTITLED "COMMERCIAL AND OTHER BUILDING PERMITS"; AS <br />AMENDED. <br />WHEREAS, in the course of the City's review of development plans, the need <br />for axchitectural and other expert planning consultation may arise, but the procedure for <br />and authority of such services is not mandated by the Code; and <br />WHEREAS, in consideration of the costs associated with development plan <br />review, including the cost of providing the Planning Commission with the consulting <br />services of a planning and development professional, amendments of North Olmsted <br />Codified Chapter 1126 are necessary and appropriate; and <br />WHEREAS, to insure the consultation of the Architectural Review Board, it is <br />the desire of this Council, as an exercise of its powers of local self-government and not in <br />conflict with general law, to establish a new and revised procedure for the review of <br />commercial development plans by directing that the Architectural Review Board be the <br />first administrative body to conduct hearings and render recommendations to the <br />Planning Commission; and <br />WHEREAS, it is the desire of Council, to enable the City to utilize the services <br />and expertise of architectural and other planning professionals during the course of <br />development plan review, that the following amendments be approved: <br />1. Delegate rulemaking authority to the Planning Commission to <br />require the submission of documents in support of building permit <br />applications; <br />2. Refer development plan review to the Architectural Review Board <br />(ARB) for recommendation prior to Planning Commission; <br />3. Authorize the Building Commissioner to recommend and refer the <br />developer for planning consultation or for review by other City <br />officials, in anticipation of Planning Commission requirements. <br />4. Outline a hearing procedure wherein the Planning Commission not <br />only may require planning consultation, at the developers expense, <br />but also reviews the recommendations of the ARB and the report <br />of the Building Commissioner on variances presented.
