CITY OF NORTH OLMSTED <br />ORDINANCE NO. 95-68 <br />BY: Mayor Edwazd Boyle <br />AN ORDINANCE AMENDING SECTIONS 139. 01 AND 139.02 <br />OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH <br />OLMSTED, WHICH ESTABLISH FEES THE POLICE <br />DEPARTMENT MAY CHARGE FOR REPRODUCING <br />REPORTS AND PHOTOGRAPHS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Ohio Supreme Court in the case of lState Ex. Rel. the Warren Newsn?pers <br />y. Hution, rlief of Potice, held that Municipal Corporations may not charge, in public records <br />requests, more than their "actual cosY" in reproducing public records; and <br />WHEREAS, it is the desire of this Council to amend Sections 139.01 and 139.02 of the <br />North Olmsted Codified Ordinances in order to bring these ordinances in to compliance with this <br />Supreme Court decision; and <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Sections 139.01, entitled "Copies of reports; charges" and 139.02, <br />which is entitled "Copies of photographs; charges" of the North Olmsted Codified Ordinances, <br />which presently read as follows: <br />139.01 COPIES OF REPORTS; CHARGES <br />The Police Division is hereby authorized to make duplicate copies of accident reports and <br />other proper police material for the use of insurance companies, attorneys or other proper persons. <br />They shall chazge five dollars ($5.00) per page for the initial report and one dollaz ($1.00) for <br />each additional side or sides of a page or pages for such service. The proceeds from the sale of <br />such service shall be credited to the General Fund. <br />(Ord. 91-34. Passed 3-5-91) <br />
