<br />AN ORDINANCE AMENDING SECTION 533.09 OF THE
<br />GENERAL OFFENSES CODE OF THE CITY OF NORTH
<br />OLMSTED, OHIO, (CODIFIED ORDINANCES) EN-
<br />TITLED " PURCHASE, USE OR POSSESSION OF LSD "
<br />TO CONFORM TO CHAN(aES ENACTED BY THE OHIO
<br />GENERAL ASSEMBLY, AND DECLARING AN EMERGENCY.
<br />WHEREAS, Council has determined that it is in the best interest of the
<br />City of North Olmsted that the North Olmsted General Offenses Code be reviewed
<br />to eliminate any conf~.cts with the provisions of the State Statutes, as enacted
<br />by the Ohio General Assembly.
<br />NOW, THEREFORE, BE IT ORDAINED by theCouncil of the City of North
<br />Olmsted, State of Ohio :
<br />Section 1. That Section 533.09, Chapter 533 (Codified Ordinances) of the
<br />North Olmsted General Offenses reading as follows :
<br />533.09 PURCHASE, USE OR POSSESSION OF LSD.

<br />(a) As used in thiAs section "hallucinogen "means d-lysergic acid
<br />diethylamide, commonly known as LSD, N-N-dimethytryptamine,
<br />commonly known as DMT, psilocygin, mescaline, peyote, bufotenin,
<br />epena, parka, ayahuasca, yage, caapi, amanita muaca~ria and any
<br />other compound, mixture, prepration or substance which produces
<br />hallucinations or illusions when introduced into the body.
<br />(b) No person shall, with intent to produce hallucinations or illusions,
<br />purchase, use, possess or have under his control an hallucinogen.
<br />Possession or control of any hallucinogen specifically named in
<br />subsection (a) hereof constitutes prima-facie evidence of a viola-
<br />tion of this section, except that this section does not apply to the
<br />use, possession or control of any hallucinogen by licensed manu-
<br />facturers, wholesalers, pharmacists, owners of pharmacies, phy-
<br />sicians end other persons, for research, clinical or medicinal
<br />purposes authorized by Federal law or any rules or regulations
<br />adopted pursuant thereto .
<br />(c) Whoever violates this section shall, for a first offense, be guilty
<br />of a misdemeanor.

<br />(a) As used in this section, " lallucinogen "means lysergic acid

<br />commonly known as DMT. , cannabis, commonly known as marijuana,
<br />hashish, ganja, or bhang, psilocybin, mescaline, peyote, bufotenin,
<br />epena, parka, ayahasca, yage, caapi, amanita, muscaria and any
<br />other oa;r-pound , mixture, preparation or substance which produces
<br />hallucinations or illusions when introduced into the body,
