CITY OF NORTH OLMSTED ORDINANCE NO. 68- 37 BY MillPr AN ORDINANCE REQUIRING A PERMIT FOR OPENING STREETS AND A DEPOSIT TO PAY THE COST OF REPAVING AND RESTORING STREETS TO ITS ORIGINAL CONDITION WHEREAS, The Legislative Committee of Council has been advised by the Service Director that the cost of pepo.i;ring a street opening permit has increased, and WHEREAS, Council wished to make the charges for the street opening permit commensurate with the cost of issuance. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio: Section 1: No person, firm or corporation shall make any openings in any streets, boulevards, avenues or public places in the City of North Olmsted until such person, firm or corporation shall file with the Engineer- ing Department of the City a written or printed application setting forth and indicating thereon the location, kind and extent of the pavement desired to be taken up, the number, purpose and size of openings or excavations which are desired or necessary. The applicant shall pay to the City of North Olmsted the sum of $5.00 to be deposited in the General Fund before the permit is issued andsM`ldeposit with the City an additional amount sufficient to cover the cost of repairing or relaying and also the cost of materials needed for repairing or relaying the treelawn, roadway or paving removed or damaged as a result of work done on or under the streets and public right of ways of the City of North Olmsted„ plus fifteen per cent ( 15% ) for the cost of inspect- ion and general supervision, as the same shall be estimated by the Engineer- ing Department of the City. Section 2: No such permit shall be issued until : A: The applicant shall have made the deposit referred to in Section 1, and said permit shall state the exact time t??el. opening or excavation is to be made, the probable length of time for doing the work and the making of the repair, the character of thepavement, including its base and the character of the work necessary for the satisfactory repairing or relaying of the roadway. B: A policy or policies of liability or indemnity _.iasurance issued by companies licensed to do business in the State of Ohio, recognizing the City of North Olmsted as an insured, in a total amount of not less than $100, 000/ $300, 000.00 for any personal injury or injuries incurred and $50, 000. 00 for any property damage caused as a result or consequence of the °making or ex- istence of such opening or excavation or the condition of the road, street, side- walk, treelawn or other public property in which the same is or has been made. Section 3: Upon the issuance of a permit as set forth in Section 2, it shall be the duty of the City Engineer to advise the Police Department of the City of North Olmsted,of the location, time and duration of the street opening in order that preparation can be made by the Police Department for traffic control: in the area of the street opening.
