A RESOLUTION AMENDING RESOLUTION NO. 69-122, ENACTED MAY 20 , 19 69 , AN D ENTITLED " A RESOLUTION DECLARING THE INTENTION OF COUNCIL TO APPROPRIATE CERTAIN PROPERTY FOR THE PURPOSE OF ADDITIONAL RECREATIONAL AREAS FOR THE CITY OF NORTH OLMSTED, AND DECLARIIVG AN EMERGENCY, " AND DECLARING AN EMERGENCY. WHEREAS, it is necessary in the judgment of this Council that immediate provisions be made for t',ze construction, maintenance and ac- quisition of certain property for the purpose of additional recreational areas located in the City of North Olmstedwhich property is more fully hereinafter described ; and WHEREAS, to provide in part the additional recreational areas re- quired, it is necessary in the opinion of this Council that said property be appropriated by the City for recreational purposes ;and WHEREAS, under Ordinance No. 68- 89 Council authorized the Mayor to negotiate for the purchase of certain portions of land of Permenant Parcel No.'s 234-22-22 and 234-22-23, and the Mayor, after several attempts to purchase said property, had been unable to purchase said property for the appraised value, Council now deems it necessary to appropriate said pro- perty for recreational purposes. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North Olmsted , State of Ohio : Section l. That it is deemed necessary and it is hereby declared to be the intention of this Council to appropriate a certain portion of Permenant Parcel No.'s 234-22-22 and 234-22-23, said portions of land to be appropriated is described as follows: " Rear Portion - john P. Mariner and J. L. Mariner Permanent Parcel No. 234-22-22 Situated in the City of North Olmsted, County of Cuyahoga and State of Ohio, and known as being part of Original Olmsted Town- ship Lot No. 10 in Tract No. 6, and bounded and described as follows: Starting at a point in the center line of Stearns Road ( 60 feet wide distant southerly measured along said center line, 117. 31 feet from the intersection of said center line and the northerly line of land con- veyed to Elijah Stearns, Jr. , be deed recorded in Volume 398, Page 78, of Cuyahoga County Records and Deeds; thence South 89° 05' 40" east parallel with the northerly line of land so conveyed to Elijah Stearns, jr. , a distance of 300.00 feet to the point of be- ginning ; thence continuing south 89° 05' 40" east a distance of 442. 79 feet to a point in the easterly line of said original Lot No. 10, in Tract IVo. 6; thence south 1° 09' 50" west, along the easterly line of said original Lot No. 10, a distance of 58.64 feet ;thence north 1° 16' east, parallel with the center line of Stearns Road a dis- tance of 58. 64 feet to the place of beginning, and containing 0.58 acre of land, be the same more of less, but subject to all legal high- ways.
