.. <br />. <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 69-67 <br />BY <br />AN ORDINANCE AMENDING THE TRAFFIC CODE OF THE <br />CITY OF NORTH OLMSTED, OHIO, SECTIQN 337.20 <br />(CODIFIED ORDINANCE), ENTITLED "MUFFLER CUT- <br />OUT: EXCESSIVE?:SMOKE OR GAS," TO CONFORM TO <br />CHANGES ENACTED BY THE OHIO GENERAL ASSEMBLY, <br />AND DECLARING AN EMERGENCY. <br />GTHEREAS, Council has determined that it is in the best <br />interest of the City of North Olmsted that the North Olmsted Traffic <br />Code be reviewed to eliminate any conflicts with provisions of the <br />State Statutes, as enacted by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of North Olmsted, State of Ohio: <br />Section l. That Section 337.20, Chapter 337 (Codified <br />Ordinance) of the North Olmsted Traffic Code reading as follows: <br />337.20 MUFFLER; MUFFLER CUTOUT; EXCESSIVE <br />SMOKE OR GAS. <br />"(a) Every motor vehicle with an internal <br />combustion engine shall at all times <br />be equipped with a muffler which is in <br />good working order and in constant opera- <br />tion, and no person shall use a muffler cut- <br />out, by-pass, or similar device upon a motor <br />vehicle on a street. <br />"(b) No person shall own, operate, or have in his <br />possession any motor vehicle equipped with a <br />device for producing excessive smoke or gas, <br />or so equipped as to permit oil or any other <br />chemical to flow into or upon the exhaust pipe <br />or muffler of such vehicle, or equipped in any <br />way to produce or emit smoke or dangerous or <br />annoying gases from any portion of such vehicle <br />other than the ordinary gases emitted by the <br />exhaust of an internal combustion engine under <br />normal operation." <br />be and the same is hereby amended to read as follows: <br />337.20 MUFFLER; MUFFLER CUTOUT; EXCESSIVE <br />SMOKE, GAS OR NOISE. <br />(a) Every motor vehicle and motorcycle with an <br />internal combustion engine shall at all times <br />be equipped with a muffler which is in good working <br />order and in constant operation to prevent exces- <br />sive or unusual noise, and no person shall use <br />a muffler cutout, by-pass or similar device upon <br />a motor vehicle on a highway. Every motorcycle <br />muffler shall be equipped with baffle plates.
