. -* <br />1- <br />CITY OF NORTH OIMSTED <br />ORDINANCE N0, 84 - 102 / ?yFr <br />? <br />BY: MR: WILA'11bSKY S 9s, <br />? <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NORTH OLMSTED OF A <br />PROPOSED AMENDMENT TO THE CHARTER OF THE CITY <br />OF THE NORTH OLMSTED BY PROVIDING FOR A NEW <br />SECTION RELATING TO THE FORFEITURE OF OFFICE <br />OF ELECTED OFFICIALS UNDER CERTAIN <br />CIRCUMSTANCES AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the Constitution of the State of Ohio, <br />Article XVIII, Section 9, a Petition containing 10% of the <br />electors of the City of North Olmsted, as defined by Article <br />XVIII, Section 14 of the Constitution of the State of Ohio, has <br />been submitted to the City Council and has been determined to be <br />sufficient; and <br />WHEREAS, Council pursuant to Article XVIII, Section 9, is <br />required to submit said Amendment to the electors of the City; <br />and <br />WHEREAS, this Council has determined the date for such <br />election to be January 15, 1985, which date is not less than 60 <br />days nor more than 120 days from the date of submission of said <br />petition. <br />NOW, THEREFORE, ]3E IT ORDAINED BY THE CJUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That pursuant to Article XVIII, Section 9, of <br />the Ohio Constitution, this Council hereby authorizes and directs <br />the submission to the electors of the City of North Olmsted at a <br />special election to be held at the usual places of voting in said <br />City on Tuesday, January 15, 1985, the following proposal to <br />amend the Charter of the City of North Olmsted. <br />That Article IX of the Charter of the City of North Olmsted <br />entitled "Nominations and Elections" be amended to include a new <br />Section 8 entitled "Forfeiture of Office", which Section 8 of <br />Article IX shall read as follows: <br />ARTICLE IX <br />SEC. 8 FORFEITURE OF OFFICE <br />Any person holding an elective office in this City shall <br />forfeit said office if during the term thereof, when there is <br />still more than two (2) years remaining in said office, said <br />person files a Declaration of Candidacy in accordance with <br />Article IX, Section 5 of this Charter for another elective office <br />other than the one said person holds. <br />SECTION 2: That it is the desire of this Council that the <br />ballot for said question shall be in the following form:
