AN ORDINANCE ACCEPTING AN EASEMENT FOR THE INSTALLATION AND MAINTENANCE OF A WATER MAIN FOR THE PURPOSE OF SUPPLYING WATER SERVICE BY THE CITY OF CLEVELAND TO THE 7515 COMPANY'S SUBDIVISON N0. 2, AND DECLARING AN EMERGENCY. WHEREAS, The 7515 Company, an Ohio Corporation, desires to extend water mains to service The 7515 Company's Subdivision No. 2, and WHEREAS, The City of Cleveland requires that extensions of water lines shall only be approved if easements are granted to both the City of Cleveland and the City of North Olmsted so that water mains may be constructed and maintained therein, and WHEREAS, this Council deems it in the best interest of the City to accept the easement described herein: NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That this Council does hereby accept an easement from The 7515 Company, an Ohio Corporation, for the installation and maintenance of a water main for the purpose of supplying water service by the City of Cleveland into the 7515 Company's Subdivision No. 2, a copy of which said easement is attached hereto and made a part hereof as though fully rewritten herein and marked Exhibit "A". SECTION 2: That the Director of Finance is hereby authorized to issue his warrant and pay to The 7515 Company, an Ohio Corporation, the sum of One Dollar ($1.00) and other valuable consideration for the granting of this easement. SECTION 3: That the Engineer of the City of North Olmsted is hereby directed to cause said easement to be recorded in the office of the Cuyahoga County Recorder. SECTION 4: That the Clerk of this Council is hereby authorized to forward a certified copy of this Ordinance to the Director of Public Utilities of the City of Cleveland. SECTION 5: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety, and welfare, and for the further reason that it is immediately necessary to install and maintain water service to The 7515 Company's Subdivision PJo. 2, and further provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
