r <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 88 - 37 <br />BY: COUNCIIMN TALLON <br />AN ORDINANCE CREATING NEW SECTION 1161.081, AMENDING SECTION <br />1161.09(A), AND CREATING NE4V PARAGRAPH (F) OF SECTION 1161.12 <br />OF THE ZONING CODE, ALL OF WHICH CONCERN GRANTING TO THE <br />PLANNING COMMISSION AUTHORI'TY TO VARY TfIE ZONING CODE RE- <br />QUIREDENTS FOR PARKING, ACCESS DRIVES AND LOADING FACILITIES, <br />UNDER CERTAIN SPECIFIED CONDITIONS, AS ANENDED. <br />WHEREAS, this Council desires, in order to promote aesthetics within <br />off-street parking areas, and to provide for pedestrian and vehicular safety <br />to authorize the Planning Commission to vary off-street parking, access <br />drive and loading facility requirements, under certain specified conditions; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OIMSTED, CUYAHOGA COiJNI'Y, AND STAT'E OF OHIO: <br />SECTION l: That there be and hereby is created new Section 1161.081 of <br />the Zoning Co e, entitled "Landbanked Parking," which as created shall read <br />as follows: <br />"1161.081 Landbanked Parking. <br />With respect to any retail, service, mixed use, industrial, <br />multiple dwelling, or hi-rise use, the Planning Commission <br />may, upon finding that the nwnber of parking spaces rec{uired <br />by Section 1161.05 are not reasonably necessary in order to <br />provide adequate parking for a proposed development, authorize <br />or require a developer to provide a lesser nwnber of actual <br />parking spaces and to landbank the remaining spaces required <br />by Section 1161.05 for future parking needs. In the event a <br />future change of use or tenancy or expansion of a use rec{uires, <br />in the deteinination of the Planning Cormnission, additional <br />actual parking, then the Planning Commission shall reauire <br />that additional actua.l parking spaces be provided from the <br />previously landbanked area of the development." <br />SECTION 2: That paragraph (a) of Section 1161.09 of the Zonin,g Code, <br />entitled "Access Driveways" which presently reads: <br />"(a) Location. The location, width and ntunber of entrance <br />and exit c.riveways to accessory parking facilities, except <br />for one-family and two family dwellings, shall be located in <br />such a manner as to interfere as little as possible with the <br />use of adjacent residential property and the flow of traffic <br />on adjacent streets. For parking areas having a capacity of <br />ten or more vehicles, the centerline of a driveway apron <br />shall be located not less than sixty feet from the nearest
