CITY OF NORTH OLMSTED <br />ORDINANCE NO. 93- 76 <br />BY.• ED BOYLE, MAYOR <br />AN ORDINANCE AMENDING PARAGRAPH (B) OFSECTION <br />137. 01 OF THE CODIFIED ORDINANCES FOR THE CITY OF <br />NORTH OLMSTED, CONCERNING THE COMPOSITION OF <br />THE LAW DEPARTMENT, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the current administrative chart for the Law Department of the City of <br />North Olmsted provides for the position of Police Prosecutor who is assigned to handle all <br />criminal matters except Building and Zoning Code violations; and <br />WHEREAS, the Assistant Prosecutor's duties, are primarily, to handle Building and <br />Zoning Code violations, and, in addition, to assist the Police Prosecutor in the performance of <br />his duties; and <br />WHEREAS, due to the recent illness of Police Prosecutor ponald P. Albenze, it has <br />become necessary that the Assistant Prosecutor, insofar as he is able, serve as Police Prosecutor <br />for an extended period of time; and <br />WHEREAS, in order to fairly compensate the Assistant Prosecutor for any extended <br />period of time in which he serves as Police Prosecutor it is necessary to amend Section 137.01 <br />of the Codified Ordinances to provide for additional compensation for the Assistant Prosecutor <br />during such extended periods of time relating to the absence of the Police Prosecutor; and <br />WHEREAS, it is further necessary to authorize the Director of Law to, from time to <br />time, retain the services of a temporary prosecutor in the event that the Assistant Prosecutor is <br />unable, for whatever reason, to fulfill the duties of acting prosecutor; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That paragraph (b) of Section 137.01, entitled "Composition," of the <br />Codified Ordinances of the City of North Olmsted, which presently reads:
