FOSTIIt & ASSOCIATES, <br />IlJC., TO PROVTDE II?GIl??FRIl?G AND CONS7RUC.TION OBSIItVATION SFRVICES FCR 7HE <br />WASTEWATEt TrtF.ATMENT PLANr, ANID DECLARING AN DMMICY. <br />WfiE.tEAS, this Council is aware of the fact that the Ohio Environmental <br />Protection Agency has ordered the City to make alterations in order to rema.in in <br />compliance with the NPDES Permit for the Wastewater Treatment Plant; and <br />WBEREAS, the Mayor has recommended that the services of the engineering <br />firm of John E. Foster & Associates, Inc., be hired to accomplish the aforesaid <br />project due to their expertise in this field; and <br />WHEREAS, the Ohio Public Works Commission has approved an interest-free <br />loan of $2,758,204.00 for financial assistance to the City for this project; and <br />WHEREAS, upon the recommendation of the Mayor, this Council does hereby <br />express its desire to have the Mayor enter into a contract with said firm for <br />and m behalf of the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF 'II3E CITY OF NORTH <br />OLMSTID, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: 'lhat the Mayor be and he is hereby authorized and directed <br />to enter into an Agreement with John E. Foster & Associates, Inc., to provide <br />engineering and construction observation services for alterations to the <br />Wastewater Treatment Plant. A copy of said Agreement is attached hereto and <br />make a part lereof and marked Exhibit "A". <br />SECTION 2: That this Ordinance is hereby declared to be an energency <br />measure imM.ediately necessary for the preservation of the public health, <br />safety and welfare, and for the further reason that it is inmediately <br />necessary to proceed with the engineering services for alterations to the <br />Wastewater Treatment Plant, and further provided it receives the affirmative <br />vote of two-Lhirds of all members of Council, it shall take effect and be in <br />force inunediately upon its passage and approval by the Mayor. <br />PASS? : J'?2:d,--CX 2. / 9 ?J <br />ATTEST: <br />?, 1 ? ?-e--??-- <br />BAPJBA? • SRfAN, Al'?S D.
