CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2013 - 27 <br />By: Mayor Kennedy and Council Member Schumann <br />A RESOLUTION DECLARING CONDITIONS WITHIN THE SANITARY <br />SEWER COLLECTION SYSTEM AT 6355 AND 6369 BARTON ROAD TO <br />BE REAL AND PRESENT EMERGE'NCIES NECESSITATING ACTION <br />WITHOUT PUBLIC BIDDING AS REQUIRED BY NORTH OLMSTED <br />CHARTER ART. VIII, SECTION 6 AND FIIRTHER AUTHORIZING THE <br />MAYOR TO ENTER INTO A CONTRACT WITH KMU TRUCKING TD <br />INSTALL INFRASTRUCTURE IMPROVEMENTS WITHIN THE <br />SANITARY SEWER COLLECTION SYSTEM, AS DETAILED IN <br />SPECIFICATIONS ON FILE IN THE DEPARTMENT OF PUBLIC <br />SERVICE, AND DECLARING AN EMERGENCY. <br />WHEREAS, sanitary sewer system back-ups in the area of 6355 and 6369 Barton Road <br />are due to sewage flow originating from opposite directions and combining within a single <br />sanitary sewer system manhole before heading east; and <br />WHEREAS, as a result of this condition, the significantly greater flow from the north <br />impedes the lesser flow from the south, thereby causing a backup of the flow from the south; and <br />WHEREAS, the proposed improvements will alter the flow characteristics by eliminating <br />the opposing flow situation to create a wye condition, resulting in a combining of flows in a more <br />laminar fashion; and <br />WHEREAS, it is the desire of the administration to proceed with this improvement <br />before the spring rain season begins, when inflow and infiltration will substantially increase the <br />likelihood of downstream flooding and result in the loss / destruction of personal or real property; <br />and <br />WHEREAS, upon design, four (4) quotes were solicited by the Director of Public Service <br />to determine a low cost, with KMU Trucking and Excavating, Inc. submitting a bid proposal of <br />$47,734.00; and <br />WHEREAS, the time associated with advertising for bid requirements will extend the <br />construction into the spring rain season; and <br />WHEREAS, it is the opinion of Brian Blum, Superintendent of the Waste Water <br />Treatment Plant; Scott Thomas, Director of Public Service; Pete DiFranco, City Engineer; and <br />Robert Binggeli, Collection Systems Superintendent that this situation is a present emergency <br />condition and that action is immediately required to preserve the public health, safety and <br />welfare; and
