<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2006 - 146 <br />BY.• Mayor O'Grady <br />AN ORDINANCE AMENDING SECTION 741.03 OF <br />CHAPTER 741 OF THE BUSINESS REGULATION CODE <br />OF THE CITY OF NORTH OLMSTED, ENTITLED <br />"DELIVERIES TO COMMERCIAL ESTABLISHMENTS, " SO <br />AS TO RENDER THE TIME PERIODS WITHIN WHICH <br />COMMERCIAL DELIVERIES NEAR RESIDENTIAL <br />NEIGHBORHOODS ARE PROHIBITED CONSISTENT <br />WITH THE LOADING AND UNLOADING PROHIBITIONS <br />CONTAINED IN SECTION 555.03(f) OF THE NOISE <br />CONTROL CODE. <br />WHEREAS, this Council previously adopted Ordinance No. 2002-171, providing for <br />amendments to various paragraphs of Section 555.03 of the Noise Control Code, including <br />paragraph (0, which as amended, prohibits loading or unloading boxes, crates, containers, <br />building materials, garbage cans and similar objects, between the hours of 9:00 p.m. and 7:30 <br />a.m., where such activity occurs within 250 feet of a residential building; and <br />WHEREAS, Section 741.03 of Chapter 741 of the Business Regulation Code, entitled <br />"Deliveries to Commercial Establishments," currently prohibits commercial deliveries of any <br />goods or merchandise between the hours of 9:00 p.m. and 7:00 a.m., where such activity <br />occurs within 250 feet of a residential building; and <br />WHEREAS, this Council wishes to establish hours of prohibition for commercial <br />deliveries which are consistent with those found in said Section 555.03( fl of the Noise Control <br />Code; " <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 741.03 of Chapter 741 of the Business Regulation Code, <br />entitled "Deliveries to Commercial Establishments," which presently reads as follows: <br />"741.03 PROHIBITIONS. <br />(a) No person shall deliver or cause to be delivered, or accept <br />delivery of, any goods or merchandise to or at a commercial establishment <br />within 250 feet of a residential building between the hours of 9:00 p.m. and <br />7:00 a.m.
