CITY OF NORTH OLMSTED <br />ORDINANCE N0.2006 - 57 <br />BY: Council Members Miller, Gareau, Ryan, Orlowski, Tallon <br />AN ORDINANCE CREATING NEW SECTION 763.01 OF NEW <br />CHAPTER 763 (RETAIL BUSINESS REGULATIONS) OF THE <br />BUSINESS REGULATION CODE IN ORDER TO PROHIBIT <br />OBSTRUCTIONS UPON PEDESTRIAN WALKWAYS LOCATED ON <br />RETAIL BUSYNESS PROPERTY, AND DECLARING AN <br />EMERGENCY, AS AMENDED. <br />WHEREAS, during the design and development process, the City's Planning and <br />Design Commission and this City Council often require retail developers to provide <br />pedestrian walkways on their property for the safety and use of retail shoppers either <br />walking from one store to another, from one building entrance to another, or from a <br />parking lot or right of way area to a retail store entrance; and <br />WHEREAS, this Council finds that a number of retail merchants are every year <br />displaying, storing or offering for sale merchandise on such designated pedestrian <br />walkways in a manner which obstructs the walkways and endangers or prohibits retail <br />shoppers from using the walkways safely for their intended purpose; and <br />WHEREAS, it is the desire of this Council to adopt business regulation <br />legislation that would prohibit retail business merchants from storing or offering for sale <br />or displaying any goods or merchandise on pedestrian walkways in a manner that <br />obstructs or unreasonably impairs the use of such walkways by pedestrians and thereb; <br />endangers the safety of retail shoppers and other pedestrians on the retail business <br />property; <br />NOW, THEREFORE, BE IT ORDAINED B Y THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That there be and hereby is created new Section 763.01 in new <br />Chapter 763 of the Business Regulation Code, which, as created, shall read in its entirety <br />as follows: <br />CHAPTER 763 <br />RETAIL BUSINESS REGULATIONS <br />763.01 PEDESTRIAN WALKWAY OBSTRUCTIONS. <br />(a) For purposes of this section: <br />(1) "pedestrian walkway" means any clearly defined area on a retail <br />business property that is designed for pedestrian travel and serves to <br />provide pedestrians access to building entrances, parking areas, public <br />sidewalks, or transit connections. <br />(2) "retail business property" means any property zoned general retail <br />business or located in any other zoning district that permits general retail <br />business uses. <br />
